Warranty Information

Warranty Statement

Cook Urological Incorporated ("Company") warrants to the purchaser of this H-30
Holmium Laser (the "Product") that, at the time of manufacture, the Product was
manufactured and tested in accordance with Good Manufacturing Practices specified
by the United States Food and Drug Administration and was true to label. In the unlikely
event of a Product failure due to defects in material or workmanship within the warranty
period, the Product will be repaired or replaced, at Cook's option, free of charge.
Because the Company has no control over the conditions under which this Product is
used, diagnosis of the patient, anatomical or biological differences among patients,
method of use or administration, or handling of the Product after it leaves the Company's
possession, the Company does not warrant a good effect or against an ill effect following
the Product's use. The foregoing warranty is exclusive and in lieu of all other warranties
whether written, oral or implied. There are no warranties of merchantability or fitness for a
particular purpose. No representative of the Company may change any of the foregoing,
and the purchaser accepts the Product subject to all terms hereof. The Company reserves
the right to change or discontinue this Product without notice.

Limits and Exclusions

The warranty does not cover consumables such as fiberoptic delivery systems, blast
shields and output lenses, or any claims related to lost profits, loss of use, or any other
indirect or consequential damages of any kind.
The warranty does not apply in the event of misuse, negligence or accidental damage
of Product. Additionally, the following events are specifically excluded from warranty
coverage: system damage due to plugging the Product into an improper electrical outlet,
enclosure damage due to mechanical shock or exposure to high temperatures, laser
cavity damage due to use of inappropriate or insufficient coolant and/or damage from
exposure to freezing conditions.
The warranty will be null and void under any of the following conditions: an unauthorized
service person has attempted to service the Product, unauthorized modifications have
been made to the Product, use of uncertified fiberoptic accessories with Product, use of
uncertified service parts with Product, and/or the Product's optical system, pulse counter
or any electronic safety circuit have been tampered with.
Warranty services will be provided only to the original purchaser at the location where the
Product was originally installed. The warranty may not be transferred without the prior
written consent of the Company.
