2.6 Cop yrigh t. All title and cop yrights in and to the Softw are Prod u ct (inclu d ing, but not lim ited to, any
im ages, p hotograp hs, anim ations, vid eo, au d io, m u sic, text, and "app lets" incorp orated into the Softw are
Prod uct), the accom p anying p rinted m aterials, and any cop ies of the Softw are Prod u ct are ow ned by
Polycom or its su p p liers. The Softw are Prod uct is p rotected by copyright law s and international treaty
p rovisions. Title, ow nership rights, and intellectu al p rop erty rights in the Softw are Prod u ct shall rem ain In
Polycom or its su p p liers. Title and related rights in the content accessed throu gh the Softw are Prod u ct is
the p roperty of su ch content ow ner and m ay be p rotected by app licable law . This Agreem ent gives you no
rights in su ch content.
2.7 Con fid en tiality. The Softw are Prod uct contains valuable p roprietary inform ation and trad e secrets
of Polycom and its sup p liers and you shall protect the confid entiality of, and avoid d isclosure and
u nau thorized u se of, the Softw are Prod u ct.
2.8 D u al-M ed ia Softw are. You m ay receive the Softw are Prod u ct in m ore than one m ed ium .
Regard less of the typ e or size of m ed ium you receive, you m ay u se only one m ed iu m that is ap p rop riate
for your single Prod u ct. You m ay not use or install the other m ed iu m on another Prod u ct.
2.9 Reservation . Polycom reserves all rights in the Softw are Prod u ct not expressly granted to you in this
Agreem ent.
3. SUPPORT SERVICES.
Polycom m ay p rovid e you w ith su p p ort services related to the Softw are Prod u ct ("Su p p ort Services"). Use
of Su p p ort Services is governed by the Polycom p olicies and p rogram s d escribed in the
Polycom -p rovid ed m aterials. Any su p p lem ental softw are cod e p rovid ed to you as p art of the Su p p ort
Services is consid ered p art of the Softw are Prod uct and is su bject to the term s and cond itions of this
Agreem ent. With resp ect to technical inform ation you provid e to Polycom as part of the Su p p ort Services,
Polycom m ay u se su ch inform ation for its bu siness p u rp oses, inclu d ing for p rod u ct su p p ort and
d evelopm ent. Polycom w ill not u tilize su ch technical inform ation in a form that p ersonally id entifies you .
4. TERMINATION.
Withou t p reju d ice to any other rights, Polycom m ay term inate this Agreem ent if you fail to com ply w ith
any of the term s and cond itions of this Agreem ent. In su ch event, you m ust d estroy all cop ies of the
Softw are Prod u ct and all of its com p onent p arts. You m ay term inate this Agreem ent at any tim e by
d estroying the Softw are Prod u ct and all of its com ponent parts.
5. UPGRADES.
If the Softw are Prod u ct is labeled as an u pgrad e, you m u st be properly licensed to u se the softw are
id entified by Polycom as being eligible for the u p grad e in ord er to u se the Softw are Prod u ct. A Softw are
Prod uct labeled as an upgrad e replaces and / or su pplem ents the software that form ed the basis for you r
eligibility for the u p grad e. You m ay u se the resu lting u p grad ed Softw are Prod u ct only in accord ance w ith
the term s of this Agreem ent. If the Softw are Prod u ct is an u p grad e of a com p onent of p ackage of softw are
p rogram s that you licensed as a single prod uct, the Softw are Prod uct m ay be u sed and transferred only as
p art of that single Softw are Prod u ct p ackage and m ay not be sep arated for use on m ore than one Prod uct.
6. WARRANTY AND WARRANTY EXCLUSIONS.
6.1 Lim ited Warran ty. Polycom w arrants that (a) the Softw are Prod u ct w ill p erform substantially in
accord ance w ith the accom p anying d ocum entation for a period of ninety (90) from the d ate of receip t by
you, and (b) any Su p p ort Services p rovid ed by Polycom shall be su bstantially as d escribed in ap p licable
w ritten m aterials p rovid ed to you by Polycom , and Polycom su p p ort engineers w ill m ake com m ercially
reasonable efforts to solve any p roblem issu es. Polycom d oes not w arrant that your u se of the Softw are
Prod u ct w ill be u ninterru p ted or error free, or that all d efects in the Softw are Prod uct w ill be corrected .
