warrants to the
origin al retail
purchaser
or
original
lessee
of
a
model
year
2004
Volk-
swagen
vehicle
an
d any subsequent pur-
chaser or lessee of
the
vehicle that
if
the
fol
-
lowing conditions are met, any authorized
Volkswagen dealer in
the continental
United
States,
Alaska,
Hawaii
or
Canada
will
remedy
any nonconformity, as determined below,
free-of-charge,
under
the following
condi-
tio
ns:
•
the
vehicle fails
to conform
at
any
tim
e
during
24
mo nths
or
24,000
miles,
whichever
occurs fi rst,
to
applicable
emission
inspec-
tion
standards
as determined
by
an
EPA Ap-
proved
State Inspectio
n and
Maintenance
Test
("1
/M Test"),
or
•
if
the
vehicle
has
been in
use
for m
ore
than
24
months
or 24,000
miles, but less than
8
years
or 80,000
miles, whichever
occurs
first, the vehicle fails
an
1/M
Test
resulting
from
a
malfun ction
of
a
catalytic
converter,
engine
electronic control
module
or
on
-
board
diagnostic device (OBD),
and
•
the fa ilure of the 1/M
Test
requires
the ve-
hicle
owner
to
bear
any penalty or
other
sanc-
tion,
including the
denial of
the
right
to use
the vehicle
under
local, state or
federal
law,
and
•
the
vehicle has
been
maintained a
nd
op-
erated in accorda nce
with Volkswagen
's
in-
structions
for proper
mainte nance and
u
se.

Use of EPA certified replacement parts
Volkswagen
may deny an
emission
perfor-
mance warranty
claim
on
the
basis
th at
a
non-EPA
certified replacement part
was
used
in
the maintenance
or
repair
of
the
vehicle if
Volkswagen can
prove tha
t
the
non-certified
part
is
either
defective
in
ma
terials
or
work-
manship,
o
r not
equivalent
fro
m
an
emission
standpoint
to the
original part,
a nd
yo
u
are
not
able
to
offer
informatio
n
that the
part
is
either
not defective
or
equivalent
to
the
orig-
inal
part
with
respect
to
its
emission
pe
rform
a
n
ce.
