5. UPGRADES.
If t he S oftware P roduct i s l abeled a s a n u pgrade, y ou m ust b e p roperly l icensed t o u se t he s oftware
identified b y P olycom a s b eing e ligible f or t he u pgrade i n o rder t o u se t he S oftware P roduct. A S oftware
Product l abeled a s a n u pgrade r eplaces a nd/or s upplements t he s oftware t hat f ormed t he b asis f or y our
eligibility f or t he u pgrade. Y ou m ay u se t he r esulting u pgraded S oftware P roduct o nly i n a ccordance w ith
the t erms o f t his A greement. I f t he S oftware P roduct i s a n u pgrade o f a c omponent o f p ackage o f
software p rograms t hat y ou l icensed a s a s ingle p roduct, t he S oftware P roduct m ay b e u sed a nd
transferred o nly a s p art o f t hat s ingle S oftware P roduct p ackage a nd m ay n ot b e s eparated f or u se o n
more t han o ne P roduct.
6. WARRANTY A ND W ARRANTY E XCLUSIONS.
6.1 Limited W arranty. P olycom w arrants t hat ( a) t he S oftware P roduct w ill p erform s ubstantially i n
accordance w ith t he a ccompanying d ocumentation f or a p eriod o f n inety ( 90) f rom t he d ate o f r eceipt
by y ou, a nd ( b) a ny S upport S ervices p rovided b y P olycom s hall b e s ubstantially a s d escribed i n
applicable w ritten m aterials p rovided t o y ou b y P olycom, a nd P olycom s upport e ngineers w ill m ake
commercially r easonable e fforts t o s olve a ny p roblem i ssues. P olycom d oes n ot w arrant t hat y our u se o f
the S oftware P roduct w ill b e u ninterrupted o r e rror f ree, o r t hat a ll d efects i n t he S oftware P roduct w ill
be c orrected. P olycom's s ole o bligation u nder t his e xpress w arranty s hall b e, a t P olycom's o ption a nd
expense, t o r efund t he p urchase p rice p aid b y y ou f or a ny d efective s oftware p roduct w hich i s r eturned
to P olycom w ith a c opy o f y our r eceipt, o r t o r eplace a ny d efective m edia w ith s oftware w hich
substantially c onforms t o a pplicable P olycom p ublished s pecifications. A ny r eplacement S oftware
Product w ill b e w arranted f or t he r emainder o f t he o riginal w arranty p eriod o r t hirty ( 30) d ays,
whichever i s l onger.
