Agreement will be free from defects in design, material and workmanship
for aperiod of ninety (90) days following date of shipment. Motorola's
obligation hereunder shall be limited to, at Motorola's option, either cor¬
recting, refunding the purchase price or replacing any product for which
written notice of nonconformance is received within ninety (90) days fol¬
lowing the date of shipment. IN NO EVENT WILL MOTOROLA BE
LIABLE LOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES.
This warranty shall not apply to any products in other than their original
condition, or to any products which Motorola determines have been subject
to misuse, neglect, improper installation, repair, alteration or damage by the
Distributor or end-user or otherwise subjected to operating or environmen¬
tal conditions in excess of the maximum values therefor in the applicable
operating instructions or specifications. THIS WARRANTY TOGETHER
WITH THE WARRANTY IN PARAGRAPH II, IS IN LIEU OE ALL
