CANON FX TYPE CARTRIDGE LIMITED WARRANTY
The limited warranty set forth below is given by Canon U.S.A., Inc. ("Canon USA") in the case of
Cartridges purchased and used in the United States, or by Canon Canada, Inc. ("Canon Canada") in the case of
cartridges purchased and used in Canada (such Canon companies being collectively referred to herein as "Canon"),
with respect to Canon brand FX Type toner cartridges ("Cartridges").
Cartridges, when delivered to you in new condition in original packaging, are warranted against defects
in material or workmanship as follows: for a period of thirty (30) days from the date of original purchase, defective
cartridges returned to a Canon USA or Canon Canada authorized dealer ("Dealer") as described below, and
proven to be defective upon inspection, will be exchanged for new Cartridges. The warranty period for any
replacement Cartridge shall begin upon shipment of the same, but shall in no event exceed the warranty period
of the defective Cartridge.
To obtain warranty service under this limited warranty, you must return the Dealer from whom you
purchased the Cartridge. Each Cartridge must be returned in its original packaging. You must enclose with the
defective Cartridge your name and address, a copy of the proof of purchase (bill of sale), a print sample from the
defective Cartridge, the name and model number of the product with which the Cartridge was used, and a
complete explanation of the problem. You must prepay any shipping charges. Cartridges covered by this limited
warranty will be replaced and returned to you without charge by the Dealer.
This limited warranty covers all defects encountered in normal use of the Cartridges, and does not
apply in the following cases:
(a)
Loss or damage to the Cartridges, or to the product with which if is utilized, due to abuse, mishandling,
improper packaging by you, alteration, accident, electrical current fluctuations, failure to followoperating,
maintenance, storage or environmental instructions prescribed in the Canon instruction manual, or
service performed by other than a Dealer.
(b)
Use of parts or supplies (other than those sold by Canon) which cause damage to the Cartridge or cause
abnormally frequent service calls or service problems.
(c)
If any Cartridge has had its lot numbers or dating altered or removed.
Cartridge yield (i.e., number of copies per Cartridge) will vary depending on the average density of
originals printed and other factors. Accordingly, no warranty is made regarding Cartridge yield. See the Canon
instruction manual for further information.
THIS WARRANTY CONTAINED ABOVE IS IN LIEU OF ALL OTHER WARRANTIES AND
CONDITIONS*, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY (OR CONDITION*) OF
MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE RELATING TO THE USE OR
PERFORMANCE OF THE CARTRIDGE. NO OTHER EXPRESS WARRANTY, CONDITION OR GUARANTY,
EXCEPT AS MENTIONED ABOVE, GIVEN BY ANY PERSON, FIRM OR CORPORATION WITH RESPECT TO
THE CARTRIDGES SHALL BIND CANON. CANON SHALL NOT BE LIABLE FOR PERSONAL INJURY OR
PROPERTY DAMAGE (UNLESS CAUSED SOLELY BY CANON'S NEGLIGENCE), LOSS OF REVENUE OR
PROFITS, INCONVENIENCE, EXPENSE FOR SUBSTITUTE EQUIPMENT OR SERVICE, STORAGE CHARGES,
OR FOR ANY OTHER SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE
USE OR MISUSE OF OR INABILITY TO USE THE CARTRIDGES, REGARDLESS OF THE LEGAL THEORY ON
WHICH THE CLAIM IS BASED, AND EVEN IF CANON HAS BEEN ADVISED OF THE POSSIBILITY OF
SUCH DAMAGES. NOR SHALL RECOVERY OF ANY KIND AGAINST CANON BE GREATER IN AMOUNT
THAN THE PURCHASE PRICE OF THE CARTRIDGE SOLD BY CANON AND CAUSING THE ALLEGED
DAMAGE. WITHOUT LIMITING THE FOREGOING, YOU ASSUME ALL RISK AND LIABILITY FOR LOSS,
DAMAGE OR INJURY TO YOU AND YOUR PROPERTY AND TO OTHERS AND THEIR PROPERTY ARISING
OUT OF THE USE OR MISUSE OF OR INABILITY TO USE THE CARTRIDGES NOT CAUSED DIRECTLY BY
THE NEGLIGENCE OF CANON. THIS LIMITED WARRANTY SHALL NOT EXTEND TO ANYONE OTHER
THAN THE ORIGINAL PURCHASER OF THE CARTRIDGE, OR THE PERSON FOR WHOM IT WAS
PURCHASED AS A GIFT, AND STATES YOUR EXCLUSIVE REMEDY.
