12. Warranty

ONLINE USV-Systeme AG (ONLINE) warrants that this product will be free of
defects in materials and workmanship for a period of two years from the date
of purchase. The extent of ONLINE's liability under the terms of this warranty
is limited to the repair or replacement (course of action to be decided by
ONLINE) of any faulty products. Where maintenance work is covered by the
warranty, there shall be no entitlement to have such work carried out unless
an RMA number (Returned Material Authorization) has first been obtained
from Customer Service. When returning products, the sender must bear all the
shipping and postage costs and include a short description of the problem that
has arisen plus proof of the date and place of purchase. This warranty does
not apply to devices damaged by accidents, negligence or misuse, or that
have been changed or modified in any way.
APART FROM ANY EXCEPTIONS STATED HEREIN, ONLINE PROVIDES
NO WARRANTY OF ANY KIND, WHETHER EXPLICIT OR IMPLICIT, IN-
CLUDING THE ASSURANCE OF COMMERCIAL QUALITY OR THE SUIT-
ABILITY OF ITS PRODUCTS FOR A SPECIFIC PURPOSE. In some jurisdic-
tions this restriction or the exclusion of implicit warranties is not allowed such
that the above restrictions or exclusions may not apply to the purchaser.
APART FROM ANY EXCEPTIONS STATED HEREIN, UNDER NO CIR-
CUMSTANCES CAN ONLINE ACCEPT ANY LIABILITY FOR DIRECT OR
INDIRECT DAMAGE, SPECIAL KINDS OF DAMAGE OR COLLATORAL OR
CONSEQUENTIAL DAMAGE SUSTAINED AS A RESULT OF USING THIS
PRODUCT, EVEN IF ONLINE WAS INFORMED ABOUT THE POSSIBILITY
OF SUCH DAMAGE ARISING. In particular, ONLINE accepts no liability for
costs of any description such as lost profits or income, the loss of equipment,
the inability to use equipment, the loss of software or data, costs associated
with obtaining replacements, claims by third parties or other costs.
