SECTION 9 – WARRANTY POLICY

SEAWIND warrants to the first-use Purchaser and any subsequent owner during the

warranty period, that any part manufactured by SEAWIND will be free of defects in

material and workmanship for a period of twelve (12) months from the date of delivery

to the first use Purchaser under normal use and service. SEAWIND's sole obligation

under this warranty shall be limited to replacing, correcting or repairing any part

manufactured by SEAWIND which is determined by SEAWIND to be defective by reason

of faulty workmanship or material.

SEAWIND warrants to the first-use Purchaser only during the warranty period that the

hulls, beams, deck and furniture of the Vessel shall be free of any structural failure

during normal operation for a period of five (5) years from the date of delivery to the

first-use Purchaser. SEAWIND's obligation under this warranty shall be limited to

replacing, correcting, or repairing any part which, in the judgment of SEAWIND, by its

failure, has impaired the structural integrity. This is the Purchaser's sole and exclusive

remedy.

This structural failure warranty shall be voided if SEAWIND should determine that said

components have been subjected to any abuse, including but not limited to collision

with other Vessels, structures or objects. The warranties are expressly conditioned

upon the Purchaser's Proper Use of the Vessel, meaning the Purchaser must use the

Vessel and operate it as directed in and after reviewing the Manuals, and perform

maintenance to the Vessel and accessories as recommended in the Manuals.

This warranty is only transferrable to a second time purchaser, if purchased by the

second time Purchaser within one year from date of initial delivery. In this instance, the

structural warranty is limited to 3 years from date of initial delivery.

SEAWIND further warrants, for a period of three (3) years, that the hull manufactured

by SEAWIND will be free of gelcoat voids and blisters.

SEAWIND's obligation under this warranty shall be limited to repairing the void or

blister and is available to the first-use Purchaser only and not transferable on re-sale of

Vessel.
