Design changes and retrofitting of instruments

Siemens reserves the right to change the design or construction of specific models of
instruments at any time without incurring any obligation to make such changes available
to individual customers or instruments. If Siemens notifies customers of a change that
improves the performance or reliability of their instrument, and requests to retrofit that
instrument, the customer must agree to allow Siemens or an authorized distributor, at
Siemens expense, to retrofit components or make design changes, which will not
adversely affect the instrument's performance characteristics.

OSHA requirements

When service is required at a customer location, the customer must provide the
Siemens representative with adequate facilities that comply with the regulations of the
Secretary of Labor under the Occupational Safety and Health Act (OSHA) of 1970, as
amended.

Software License

No title or ownership of software is transferred to the customer. The software component
of this Siemens system and any of its modules are merely licensed to the customer for its
own use on such system.
Any software (including documentation) provided for the system contains proprietary
information constituting valuable trade secrets and is protected by federal copyright law.
The software may not be disclosed, in whole or in part, to third parties or duplicated in
any form or medium except as necessary for program execution and archival storage.
Prior to change of ownership, Siemens must be contacted by the original customer to
establish terms for the transfer of the software license.
