Additional Terms for Oracle Software, Hardware and Services
Where the Software includes software, including any operating system, provided by Oracle (the
"Oracle Programs"), or where any hardware or services are provided by Oracle, the following terms
will apply in addition to the terms contained in the body of the Agreement:
1. Your use of the Oracle Programs delivered with any hardware is restricted to the terms of
the Agreement, and such Oracle Programs may only be used as incorporated in, and as
part, of such hardware.
2. Ancillary programs are those third party materials specified in the applicable
Documentation which may only be used for the purposes of installing or operating the
programs with which the ancillary programs are delivered.
3. If You decide to finance Your acquisition of the Oracle Programs, or any hardware or
services provided by Oracle, You will follow Oracle's policies regarding financing, which
are available at http://oracle.com/contracts.
4. Any additional programs that Oracle may include with the Oracle Programs or the
hardware provided by Oracle may be used for trial, non-production purposes only. You
may not use such additional programs to provide training or attend training provided by
ZEISS or a third party on the content and/or functionality of the programs. You will have
thirty (30) days from the delivery date of the additional programs to evaluate such
programs, subject to the terms of the Agreement. If You decide to use the additional
programs after the thirty (30) day trial period, You must obtain a license for such
programs from ZEISS. If You decide not to obtain a license for the additional programs
after the thirty (30) day trial period, You will cease using and will delete any such
programs from Your computer systems. Additional programs included with any order are
provided "as is" and Oracle does not provide technical support or offer any warranties for
these programs.
5. Any third party firms retained by You to provide computer consulting services are
independent of Oracle and are not Oracle's agents. Oracle is not liable for nor bound by
any acts of such third party firm.
6. Hardware, if purchased from Oracle, includes Oracle's hardware warranty in effect at the
time the hardware is purchased. Oracle's hardware warranty can be accessed at
http://www.oracle.com/support/policies.html.
7. You have not relied on the future available of any Oracle Programs, hardware or updates
in entering into the Agreement. However, (a) if You order technical support from Oracle,
the preceding sentence will not relieve Oracle of its obligation to provide updates under
such order, if-and-when available, in accordance with Oracle's then-current technical
support policies and (b) the preceding sentence will not change the rights granted under
the Agreement for any Oracle Program licensed under the Agreement, per the terms of
the Agreement.
Acknowledgment
You acknowledge that you have read all the provisions in this Chapter, including this License and
Limited Warranty, understand them, and agree to be bound by their terms and conditions.
