A. OREC WARRANTY – The warranties described below apply to the original purchaser of a new product

("OREC Product") of OREC America, Inc. ("OREC") purchased from OREC or an authorized OREC Product

distributor/dealer (authorized OREC Product distributors/dealers are found in the OREC America website

https://www.orecamerica.com/). Under these warranties, OREC will repair or replace, at its option, any covered part

which is found to be defective in material or workmanship if the defect is reported in the manner provided in the

OREC America website within the following time period starting from the date of delivery of OREC Product to the

purchaser ("Warranty Term") under the following conditions:

*The term "Residential" means the OREC Product used only for personal purpose. The term "Commercial" means

the OREC Product used wholly or partly for commercial, institutional, rental, or any other purpose.

The purchaser will be responsible for any service call and/or transportation of product to and from the distributor's

or dealer's place of business, for any premium charged for overtime labor requested by the purchaser, and for any

service and/or maintenance not directly related to the defect covered under the warranties. These warranties are not

transferable.

B. OREC IS NOT RESPONSIBLE FOR THE FOLLOWING: (1) used OREC Product; (2) any OREC Product

that has been altered or modified in ways not approved by OREC; (3) depreciation or damage caused by normal

wear, lack of reasonable and proper maintenance, failure to follow operating instructions, misuse, lack of proper

protection during storage, or accident; or (4) normal maintenance parts and service, including, without limitation,

batteries, belts, cables, blades, tines, tires, tubes, brake shoes, flappers, lights, filters, and bolts and nuts fixing any of

the foregoing parts.

C. LIMITATION OF IMPLIED WARRANTIES AND OTHER REMEDIES –To the extent permitted by law,

neither OREC nor its parent company nor its affiliated company makes any warranties, representations or promises

as to the quality, performance or freedom from defect of the OREC Product covered by this warranty. IMPLIED

WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE

EXTENT APPLICABLE, WILL BE LIMITED IN DURATION OF "WARRANTY TERM" AS DEFINED

ABOVE. THE PURCHASER'S ONLY REMEDIES IN CONNECTION WITH THE BREACH OR

PERFORMANCE OF ANY WARRANTY ON THE OREC PRODUCT ARE THOSE SET FORTH ON THIS

OREC AMERICA, INC. LIMITED WARRANTY. IN NO EVENT WILL OREC, ITS PARENT COMPANY OR

ITS AFFILIATED COMPANY, OR ITS AUTHORIZED OREC PRODUCT DISTRIBUTOR OR DEALER BE

LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. (Note: some states do not allow limitations on

how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages so the

above limitations and exclusions to the extent not allowed by the states may not apply to you.) This warranty gives

you specific legal rights, and you may also have other rights which vary from state to state.

D. NO WARRANTY PROVIDED BY DISTRIBUTOR OR DEALER – Neither a distributor nor a dealer of

OREC Products makes any warranty of its own and has any authority to make any representation or promise on

behalf of OREC, or to modify the terms or limitations of this warranty in any way.
