Dexcom shall not be liable for any special, incidental,
consequential, or indirect damages, however caused,
and on any theory of liability, arising in any way out of
the sale, use, misuse, or inability to use, any Dexcom
ONE or any feature or service provided by Dexcom for
use with the Dexcom ONE.
These limits on Dexcom's warranty and liability
obligations apply even if Dexcom, or its agent, has
been advised of such damages and notwithstanding
any failure of essential purpose of this Limited
Warranty and the limited remedy provided by
Dexcom.
This Limited Warranty is only provided to the original
User and cannot be transferred to anyone else, and it
states User's exclusive remedy.
If any portion of this Limited Warranty is illegal
or unenforceable by reason of any law, such
partial illegality or enforceability shall not affect
the enforceability of the remainder of this Limited
Warranty. This Limited Warranty does not change
or limit your rights under any warranty the User has
from a seller or under mandatory applicable law.
