6. The guarantees of per-
formance arising from the
BMW CE 04 Battery Certificate
require that maintenance be
carried out at the intervals
specified by the manufacturer
and that inspections and
any repairs, if necessary, be
conducted as part of the
maintenance performed on the
high-voltage cell modules. The
guarantees of performance
shall not apply for material
defects to the high-voltage cell
modules or a disproportionate
loss of capacity that are the
result of accident damage or
that occurred because
the BMW CE 04 vehicle was
operated under conditions
for which it was not certified
(e.g., in a country other than
the initial country of deliv-
ery with different certification
conditions), or
the BMW CE 04 vehicle
was handled improperly or
overused, e.g., in a motor
sport competition, or
parts were added to the
BMW CE 04 vehicle, the use
of which was not approved
by the manufacturer, or the
BMW CE 04 vehicle or vehicle
parts (e.g., software) were
modified in a manner that
was not approved by the
manufacturer, or
the regulations for the oper-
ation, maintenance and care
of the BMW CE 04 vehicle (in
particular, in accordance with
the Rider's Manual) have not
been followed, or
the high-voltage battery has
been opened or removed
from the BMW CE 04 vehi-
cle.
7. This BMW CE 04
Battery Certificate is a
supplemental element of the
sales terms and conditions
for new BMW CE 04 vehicles.
Guarantees of performance
and claims in accordance with
the sales terms and conditions
for new BMW CE 04 vehicles
shall remain unaffected by the
guarantees of performance
arising from this BMW CE 04
Battery Certificate.
8. If ownership of the
BMW CE 04 changes hands,
the guarantees of performance
arising from the BMW CE 04
Battery Certificate shall remain
unaffected.
