DFARS/Restricted Rights Notices
If software is for use in the performance of a U.S. Government prime contract or
subcontract, software is delivered and licensed as "Commercial Computer Software" as
defined in DFAR 252.227-7014 (Feb 2014), or as a "Commercial Item" as defined in FAR
2.101(a) or as "Restricted Computer Software" as defined in FAR 52.227-19 (Dec 2007) or
any equivalent agency regulation or contract clause. Use, duplication or disclosure of
Software is subject to VIAVI Solutions' standard commercial license terms, and non-DOD
Departments and Agencies of the U.S. Government will receive no greater than Restricted
Rights as defined in FAR 52.227-19(c)(1-2) (Dec 2007). U.S. Government users will
receive no greater than Limited Rights as defined in FAR 52.227-14 (June 1987) or DFAR
252.227-7015 (b)(2) (November 1995), as applicable in any technical data.
California Proposition 65 Position Statement
California Proposition 65, officially known as the Safe Drinking Water and Toxic
Enforcement Act of 1986, was enacted in November 1986. The proposition aims to protect
individuals in the state of California and the state's drinking water and environment from
excessive exposure to chemicals known to the state to cause cancer, birth defects or other
reproductive harm. The state maintains a list of such chemicals.
Businesses are required to provide a clear and reasonable warning before knowingly and
intentionally exposing individuals in the state of California to a listed chemical. A warning
is not required if the anticipated exposure level will not pose a significant risk of cancer or
is significantly below levels observed to cause birth defects or other reproductive harm.
VIAVI products contain chemicals such as lead and lead compounds that are listed by the
state of California as causing cancer, birth defects or other reproductive harm. However,
VIAVI products are intended for use in occupational settings only and are not for consumer
sale or use. Therefore, exposure to the hazardous chemicals in VIAVI products is
considered "occupational exposure". Commercial customers who purchase products for
use in occupational settings in the state of California, please refer to
www.P65Warnings.ca.gov for more information on the warning requirements.
