1. RESA: Franco Fabbrica Codogno (LO), Italia.
2. CONSEGNA: La TELME si impegna a fare 1 1 possibile perche la consegna avvenga entro i termirii fissati. Sono escluse In
ogni caso penalita o risarclmento donni che derivassero all'acquirente per I'eventuale ritardata consegna. La merce si
intende consegnata dol momento In cui la stessa viene affidata al vettore. Le spese di trasporto sono a carico dell'ac-
quirente e, quando non vi siano da parte di questi precise e scrltte disposizloni diverse, II trasporto verrd effettuato col
mezzo ritenuto piu adatto dalla ditto venditrlce. In ognl caso la merce viaggia per conto e risctilo deH'ocqulrente, anche
nel caso che II trasporto vengo eseguito a euro delta TELME.
Verlficare sempre I'integrita delta merce all'atto del ricevimento. Se necessario, Indlcare sulla bolla di consegna la RISERVA
di accettazione, se la merce risulta danneggiato. Indlcare alia TELME S.p.o. la natura del danno entro 48 ore dal ricevimen-
to alia TELME S.p.A.
3. RECLAMI: Eventuali reclami devono essere fatti per iscritto enlro 7 giornl dal ricevimento delta merce.
4. PATIO DI RISERVATO DOMINIO: Nel caso di vendlto coi r pagomento dilazionoto o differlto, le parti convengono che lo
merce si Intende venduta con patto di riservato dominio.
5. PAGAMENTI: Eventuali ritardati pagamenti ci autorizzano a sospenslone/annullamento degli ordini In corso. In caso di rltar-
doto pagomento verranno addebitati aH'ocquirente gli Interessi.
6. INSTALLAZIONE e ASSISTENZA: L'lnstallozione e a carico deH'ocquirente, come pure 1 cost! derivanti dall'asslstenza tecni-
c o eseguita dal rivenditore.
7. GARANZIA: La TELME garantisce le macchine da essa vendute per un periodo di mesi 12 dalla data di consegna. Durante
1 1 periodo di goronzia la venditrlce si impegna a sostituire, gratuitamente franco fabbrica, i pezzi che dovessero guastor-
si per evidente difetto di lavorazlone o cattiva qualitd del materiali; le parti sostituite restano di proprietd delta TELME e
dovranno essere ritornate alia sede delta medeslma franco di ogni spesa. Se per la sostituzione del materiale difettoso si
rendesse necessario I'lntervento dl personate tecnico le spese relative alia mano d'opera ed eventuali spese dl trasfer-
ta, verranno addebitate all'acquirente. Sono esclusi dalla garonzla eventuoll rabbocchi dl gas frigorlgeno. La garanzta
d e c a d e se le macchine vengono usate In mode non conforme alle IstruzionI delta venditrlce; se esse vengono volonta-
rlamente o involontariamente dannegglate; se esse vengono modlflcate, riparate o smontate anche solo parziolmente,
fuori dalle officlne TELME o d o personate non d a essa espressomente autorizzoto per iscritto. La garanzia d e c a d e anche
se gli altacciamenti (elettrlcl e Idrlcl) per I'alimentazione delta macchino, che sono di spettonzo dell'acquirente, stano
Inadeguoti. L'interruzione del pogamento convenuto nelia proposta di vendita ed accettato dalla venditrice, sard
causa delta sospensione della garanzia,
GARANZIA SUPPLEMENTARE: TELME garantisce le macchine da essa vendute, secondo le modalita sopra esposte per un
periodo di 12 mesi dal a data di consegna. Per overe diritto olio garanzta supptementare di 1 anno, che oumenta 1 1 perio-
do complessivo dl garanzia a 24 mesi, I'ocqulrente deve ritagliore e compltare in ogni sua parte, firmare e spedire con rac-
comandato alia TELME, entro 15 glorni dalla data d'Installazione, la cartollna di garanzia allegata ai manuale "ISTRUZIONI
PER L'USO". Se la TELME non riceverd la cartolino di garanzta non riconoscerd II periodo supplementare di garanzta.
8. RESPONSABILITA': La TELME e esonerata da ognl responsabllltd ed obbligazlone per qualsiasi Incidente alle persone e d alle
cose che possono comunque verificarsi per e/o durante I'uso delle macchine fornlte e per cause in dipendenza delle
medesime, cio anche durante Teventuale coltaudo e pure se I'lncldente e derivante d a difetto di costruzione o materia-
li, Deve Inoltre conslderarsi espressomente esclusa qualsiasi oltra pretesa di rimborso per mancati guadagni imputabili o d
eventuate non funzlonamento degli opparecchl. I prodotti non possono essere utilizzati per scopi diversi d a quelli indicatl.
9. CARATTERISTICHE TECNICHE: Per quanto slano esposte con la maggiore approssimazione posslbile, non sono impegnative per
la venditrlce. Anche le caratteristiche di produzione e rendlmento sono sotamente indicative e sono date In cllma temperate.
10.FORO COMPETENTE: In deroga alle disposlzioni del Codice di Procedura Civile i contraenti convengono che, nel caso
dovesse sorgere controversia. In ordine al presente contratto, unico foro competente sard quelle di Lodi.

1. DELIVERY: Ex Works Codogno (LO), Italy.
2. CONSIGNMENT: TELME does Its best that consignment Is carried out within established time. Penalties or Indemnity of
damages, at purchaser's favour, for the delayed consignment are in any case excluded. Goods are Intended as delive-
red when they are handed to the trasporter. Shipment expenses are at purchaser's charge. When there are no precise
and written arrangements from the purchaser, the shipment will be carried out with the most suitable means for TELME.
Goods ore shipped at the purchaser's charge and risk, also In case that shipment Is carried out by TELME. When recei-
ving the goods check if they are in good condition. If necessary, i.e. goods are damaged, mark delivery note witti your
proper reserves. Inform TELME S.p.A. within 48 hours about damage.
3. CLAIMS: Eventual claims must be made no later than 7 days from receipt of the goods.
4. RESERVED OWNERSHIP AGREEMENT: In case of selling with extended or deferred payment, the parties agree that the
goods are intended as sold with reserved ownership agreement.
5. PAYMENTS: Eventual delays of payment authorize TELME to suspend or cancel outstanding orders. In case of delay of pay-
ment ttie Interest will be at purchaser's charge.
6. INSTALLATION and SERVICE: Installation Is at the expense of the buyer, as well as the costs of after sale service carried out
by the distributor.
7. WARRANTY: TELME warrants sold machines for a lime of 12 months from delivery dote. During the time of warranty, TELME
will replace, free ex-factor/, all parts damaged for evident defects of manufacturing or for a bad quality of the materials.
Replaced parts still belong to TELME and will have to be relumed to the head office free of charge. Labour and eventual
travelling expenses will be at purchaser's charge. Freon gas filling is excluded from the vorranty. The warrant/ declines if
the machine is used not in conformit/ with the soles instructions; it they are damaged willingly or unintentionally; if the
machine is modified, repaired or disassembled by not authorized staff. The warranty also declines if the connections,
power and water, for the feeding of the machine (at purchaser's charge) are uncorrect. Suspension of payment, agreed
in the sales oroDOSol and accepted by TELME will cause the suspension of warrant/.
ADDITIONAL WARRANTY: TELME warrants sold machines according to above mentioned conditions for a time of 12 months
from delivery date. In order to acquire the right of having the additional warranty of 1 year, so that ttie warranty is exten-
ded to a total time of 24 months, the buyer has to cut out, fill In, sign and send back, by registered letter, to TELME, within
15 days from date of installation, the warranty cord which Is enclosed in the manual "OPERATING INSTRUCTIONS". If TELME
doesn't receive the warrant/ card, the additional warranty time will not be acknowledged.
8. RESPONSIBILITY: TELME Is free from every responsibility and obligation for any futher accident to people a n d goods that
could verify for and/or during the use, for reasons or/in dependence on supplied machines, during eventual testing and
even if accident is due to defects of manufacturing or materials. Any further claims of reimbursement must be conside-
red excluded. Products cannot be used for intent different to that indicated.
9. TECHNICAL FEATURES: Even It they are illustrated with accurate indication, they are not binding for TELME. As well produc-
tion and performance data are only Indicative and supplied In ambient temperature.
10.COMPETANT COURT: Notwithstandlna the Civil Code Procedure, contracting parties agree that, if any dispute could arise
the only Court of LodI (Italy), according to the present agreement, will be competent.
