This operator's manual contains the legally required information for end users according to "US
Regulation 40 CFR Parts 1039 and 1068".
Tier 2 certification as per CFR 1039
This diesel engine is certified Tier 2 according to "USA EPA 40 CFR 1039".
Diesel engine owner is responsible to comply with this requirement: "Engines only to be
installed in emergency stationary standby power applications".
Operation of diesel engine on other application shall be expressly prohibited and Kohler Co.
excludes any liability, including but not limited to warranty, to the extent the diesel engine is
operated outside of the conditions to which it is type approved.
Notwithstanding anything to the contrary set forth above, in no event shall Kohler Co. be liable
for any misuse, abuse or any other improper use of the diesel engine (including any parts
thereof) or for any modification of the diesel engine (including parts thereof) that has not
received Kohler Co.'s explicit prior written approval.
Compliance
In accordance with US Regulation 40 CFR Part 1039 and 1068 (§1039.125 and §1068.110), the
owner has the option to select any qualified repair shop for proper maintenance, replacement
or repair of emission-related components with original parts or equivalent replacement parts.
The owner is required to have warranty and recall services paid for by Kohler Co. performed by
an authorized Kohler Co. dealer/service center.
