Limitations of Warranty
The foregoing warranty shall not apply to defects resulting from: (1) Improper
or inadequate maintenance by Buyer or an unauthorized person, (2) Using
accessories and/or consumables that are not approved by Abbott, (3)
Unauthorized repairs, modifications, misuse, or damage caused by Buyer
or an unauthorized person, or (4) Operating the DIGIVAL outside of the
environmental specifications of the product.
THE WARRANTY SET FORTH ABOVE IS EXCLUSIVE AND NO
OTHER WARRANTY, WHETHER WRITTEN OR ORAL, IS EXPRESSED
OR IMPLIED. ABBOTT SPECIFICALLY DISCLAIMS THE IMPLIED
WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT,
AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT WILL
ABBOTT BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL,
CONSEQUENTIAL, OR PUNITIVE LOSS OR DAMAGES IN ANY WAY
RELATED TO THE DIGIVAL, EVEN IF ABBOTT IS AWARE OF THE
POSSIBILITY OF SUCH CLAIM OR DAMAGES.
