P ALLETSANDSKIDS.(Unlessotherwisestated)palletsandskidswillnotbechargedextra butifnotreturnedtoRettig’splaceofbusiness(carriagepaid)ingoodcondition,within3 weeksofreceiptbytheCustomerRettigwillbeentitledtochargetheCustomerforsuch palletsandskids. 11.  C ONFIDENTIALITY 11.1 T heCustomerwillkeepconfidentialalltechnicaldata,commercialinformation, know-how,specifications,inventions,processes,initiativesandotherinformationwhichis ofaconfidentialnatureandwhichhasbeendisclosedtotheCustomerbyRettigorits agentsandanyotherconfidentialinformationconcerningRettig’sbusinessoritsproducts whichtheCustomermayobtain(“ConfidentialInformation”). 11.2 T heCustomerwillrestrictdisclosureoftheConfidentialInformationtosuchofits employees,agentsorsubcontractorsasneedtoknowthesameandwillensurethatsuch employees,agentsorsubcontractorsaresubjecttoequivalentobligationsofconfidentia- lityasbindtheCustomer. 11.3 T heCustomerwillnotwithoutthepriorwrittenconsentofRettigpublishordisclosethe ConfidentialInformationtoanythirdpartyormakeanyuseoftheConfidential InformationexcepttotheextentnecessarytoimplementtheContract.

E XPORTSALES 14.1 W heretheWorksaresuppliedforexportfromtheUnitedKingdomtheprovisionsofthis clause14will(subjecttoanyspecialtermsagreedinwritingbetweentheparties)apply despiteanyotherprovisionoftheseConditions. 14.2 T heUniformLawsonInternationalSalesAct1967willnotapply. 14.3 U nlessotherwiseagreedinwritingthecurrencywillbepoundssterling.TheCustomerwill establishandmaintaininfavourofRettiganirrevocableandconfirmedletterofcreditin EnglishwithaUKclearingbankpayableondraftsdrawnatsightonpresentationtothe bankbyRettigofacertifiedcopyofRettig’sinvoice.Allbankchargesandotherexpensesin relationtotheletterofcreditwillbebornebytheCustomer. 14.4 U nlessotherwiseagreedinwritingWorkswillbesoldC.I.F (asdefinedinINCOTERMS2000Edition). 14.5 T heCustomerwillberesponsibleforcomplyingwithanylegislationorregulation governingtheexportoftheWorksfromtheUnitedKingdomandtheimportationofthe Worksintothecountryofdestinationandforpaymentofanyrelevantdutiesortaxes. 15.  L IEN.RettigwillhaveinrespectofunpaiddebtsduetoitfromtheCustomeragenerallien onallpropertyoftheCustomerwhichisinRettig’spossessionforwhateverreasonand whetherworkeduponornot. 16.  F ORCEMAJEURE.RettigwillnotbeliabletotheCustomerorbedeemedtobeinbreachof theseConditionsbyreasonofanydelayinperformingorfailuretoperformanyofits obligationsundertheseConditionsifsuchdelayorfailurewasbeyondtheRettig’s reasonablecontrol.IfRettigisunabletoperformitsobligationsundertheseConditionsin accordancewiththisclause16itwillpromptlynotifytheCustomerofthenatureand...
