your Xbox 360 S or Accessory is used
with products not sold or licensed by
Microsoft (including "pirated" games
and accessories not manufactured or
licensed by Microsoft);
your Xbox 360 S or Accessory is
opened, modified, or tampered with
(including any attempt to defeat any
Xbox 360 S or Accessory security or
anti-piracy mechanism), or its serial
number is altered or removed;
your Xbox 360 S or Accessory is
damaged by any external cause
(including inadequate ventilation, or
other failure to follow instructions in the
printed user instruction manual
packaged with the Xbox 360 S or
Accessory);
your Xbox 360 S or Accessory is
repaired by anyone other than
Microsoft; or
you attempt to defeat or circumvent
your Xbox 360 S or Accessory security
or anti-piracy system.
You also acknowledge that the foregoing
may cause your Xbox 360 S or Accessory to
stop working permanently.
EXCEPT FOR ANY STATUTORY GUARANTEE
WHICH MICROSOFT MAY OWE YOU UNDER
ANY LOCAL LAW APPLICABLE TO YOU, THIS
MANUFACTURER'S GUARANTEE IS THE
ONLY GUARANTEE GRANTED TO YOU BY
MICROSOFT WITH RESPECT TO YOUR XBOX
360 S OR ACCESSORY AND ANY PRODUCT
MANUAL(S) OR OTHER MATERIALS THAT
MAY COME WITH IT.
IF ANY SUCH LOCAL LAW APPLICABLE TO
YOU GIVES YOU ANY IMPLIED GUARANTEE,
INCLUDING AN IMPLIED GUARANTEE OF
MERCHANTABILITY OR FITNESS FOR A
PARTICULAR PURPOSE, THE DURATION OF
SUCH IMPLIED GUARANTEE WILL BE
LIMITED TO THE MANUFACTURER'S
GUARANTEE PERIOD, UNLESS OTHERWISE
PROVIDED BY SUCH APPLICABLE LAW.
2. Process to obtain the manufacturer's
Guarantee Service
This Manufacturer's Guarantee automatically
becomes effective, in accordance with the
conditions set forth herein, upon purchase of
your Xbox 360 S or Accessory from an
authorized retailer. You do not need to
register the purchase of your Xbox 360 S or
Accessory to make this Manufacturer's
Guarantee effective.
Upon encountering a technical problem with
your Xbox 360 S or Accessory, please first
use Microsoft's troubleshooting tips available
at http://xbox.com/support.
In the event that you do not manage
to resolve your technical problem with such
troubleshooting tips, then follow the online
process available at http://xbox.com/support
or call the number listed in this manual for
your country of residence for phone
assistance if you have no access to the
Internet.
Before sending your Xbox 360 S or Accessory
to Microsoft for service, please ensure to
make a copy of any data you want to save,
and delete anything you consider
confidential. You expressly acknowledge that
Microsoft is not responsible for, and may
erase, any of your data stored in your Xbox
360 S or Accessory when sent to Microsoft
for service.
3. microsoft's responsibility
After you have returned your Xbox 360 S or
Accessory to Microsoft, Microsoft will inspect
it and determine in its sole discretion
whether the malfunctioning of your Xbox
360 S or Accessory occurred during the
Guarantee Period and under normal
conditions of use.
If your Xbox 360 S or Accessory is eligible for
Manufacturer's Guarantee service, Microsoft
will (at its option) repair or replace it, or
refund you with its purchase price, unless a
mandatory provision of any local law
applicable to you provides otherwise.
You acknowledge that repair may use new or
refurbished parts, and that replacement may
be with a new or refurbished unit.
After repair or replacement, your Xbox
360 S or Accessory will remain covered by this
Manufacturer's Guarantee for the longer of
either the remainder of this Manufacturer's
Guarantee Period or a term of ninety five (95)
days after shipment of your repaired or
replaced Xbox 360 S or Accessory by Microsoft
to you.
UNLESS OTHERWISE PROVIDED UNDER
APPLICABLE LOCAL LAW, MICROSOFT'S
