emergencysituationexistswhen a warranted part or a dealer is not reasonablyavailableto the
owner,repairsmay he performedat any availableservice establishment, o r by the owner,usingany
replacementpart. The Distributorshall reimbursethe ownerforthe expenses,includingdiagnostic
charges,notto exceedthe Distributor'ssuggestedretail priceforall warrantedparts replacedand
labor chargesbasedon the Distributor'srecommendtimeallowancefor thewarranty repairandthe
geographically appropriatehourlylabor rate. Theowner may reasonablyhe requiredto keep receipts
andfailed parts in orderto receive compensation.
ThisEmissionControlSystemWarrantyis in additionto the standardLimitedWarranty.
EXCLUSIONS AND LIMITATIONS
Thiswarrantydoes notcoverthe following:
• Failuresor malfunctionsofthe emissioncontrolsystemscausedby abuse,alteration,ac-
cident,misuse,the use of leadedgasoline.
• Replacement of expendablemaintenanceitems unlesstheyare originalequipmentdefective
in materialor workmanshipundernormaluse, andthefirst requiredreplacementintervalfor the item
has not beenreached. Expendablemaintenanceitems includehut not limitedto spark plugs,filters,
coolant,lubricants,gaskets,hoses,and belts.
• Replacements of parts and other servicesand adjustments for required maintenance.
• Any vehicleequippedwith an odometeror hourmeterwhere the reading is alteredso that
actual mileagecannothe readilydetermined.
• Repairsor replacementsas a resultof:
o Accident
o Misuse
o Use of replacementparts or accessoriesnot conforming to theoriginal specifications which
adverselyaffectperformance
• Physicaldamage,corrosion,or defectscausedby fire, explosionsor similarcausesbeyond
the controlofthe Distributor.
• Failuresnot causedby a defect in materialor workmanship.
Use ofthe vehicle in any typeof competitiveracingor relatedevents immediately and completelyvoids
thisand all otherwarranties.
LIMITEDLIABILITY
Theliability ofthe DistributorunderthisEmissionControlSystemWarrantyis limitedsolelyto the
remedyingof defectsin materialworkmanshipby an authorizeddealer at its placeof businessduring
customarybusinesshours.Thiswarrantydoes not coverinconvenience or loss of use of thevehicle
or transportation of the vehicleto/fromthe authorizeddealer.The Distributoris not liableto any person
for incidental,consequential o r specialdamagesof any description,whetherarising out of expressor
impliedwarranty or any othercontract,negligenceor othertortor otherwise.
No expressemissioncontrolsystemwarranty is given by the Distributorexceptas specificallyset forth
herein. Any emissioncontrolsystemwarranty impliedby law, includingany warrantyof merchant-
ability or fitnessfora particularpurposeis limitedto the expressemissioncontrolsystemwarranty
termsstated in thiswarranty. Theforegoing statementsof warrantyare exclusiveand in lieu of all
otherremedies. All expresswarrantiesnot statedin this warrantyare disclaimed. Some states do not
allowlimitationson how longan impliedwarranty lasts,so the above limitationsmay not apply if it is
inconsistentwith the controllingstate law.
