We, Bluworld of Water, LLC do hereby warrant that all materials furnished, and work performed related to the
Blu‐Guard Water Feature, are free of defects for a period of (2) years (not including labor) from the date of
installation.
Nothing in the above shall be deemed to apply to work which has been abused or neglected by the owner.
The water feature requires regular maintenance and/or system inspections as laid out in the O&M manual
provided.
When applicable, the customer is responsible for providing a means for accessing the top of their water
feature (e.g. lift(s) or scaffolding). Customer must provide lift(s) or scaffolding during installation, any future
service, any warranty work, and for all future regular maintenance. Bluworld will not be responsible for
providing lift(s) or scaffolding for any reason at any time in the future, including warranty work, the customer
is responsible for providing a means of access to the top of their own water feature.
Bluworld honors manufacture warranties (2) two years post installation. This warranty does not include the
replacement of bulbs in any submersible or recessed light fixtures. The original manufacturer warrants the
light fixtures installed for a period of (1) one year. The submersible pumps are warranted by the
manufacturer for a period of one year against defective material, use of harsh chemicals and faulty operation.
This warranty does not cover the labor for replacement of parts/components not manufactured by Bluworld.
This also excludes wearable items, such as pump impeller, check valves, etc.
EXCEPT AS OTHERWISE EXPRESSLY STATED HEREIN THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING,
WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR PURPOSES. EXCEPT AS OTHERWISE
EXPRESSLY STATED HEREIN, THE SALE OF THE PRODUCT IS "AS IS," "WHERE IS" AND "WITH ALL FAULTS." IN NO EVENT
SHALL BLUWORLD BE LIABLE FOR LOST PROFITS, INCIDENTAL DAMAGES, CONSEQUENTIAL DAMAGES, LOSSES OR
EXPENSES, WHETHER DIRECT OR INDIRECT, INCURRED BY PURCHASER AS A RESULT OF ANY DEFECT IN THE PRODUCTS
SOLD PURSUANT TO THIS AGREEMENT, REGARDLESS OF WHETHER PURCHASER'S CLAIM IS IN WARRANTY, BREACH OF
CONTRACT, TORT OR OTHERWISE. THE MAXIMUM LIABILITY OF BLUWORLD, WHETHER ARISING FROM BREACH OF
CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, BREACH OF WARRANTY OR OTHERWISE, SHALL BE THE
PURCHASE PRICE FOR THE GOODS.
