DigitalSecurityControls("DSC"), a division of Tyco SafetyProductsCanada Ltd, a part of the Johnson Controlsgroup of companies("JCI"), warrantsthe
originalpurchaser that for a period of twelve monthsfromthe date of purchase, the product shallbe free of defectsin materialsand workmanship under
normaluse. During the warrantyperiod, JCI shall, at its option, repair or replace any defective product upon return of the product to itsfactory, at no
charge for labour and materials. Any replacement and/or repaired partsare warranted for the remainder of the originalwarranty or ninety (90) days,
whichever is longer. The originalpurchaser must promptly notifyJCI in writing that there isdefect in material or workmanship, such written notice to be
received in alleventsprior to expiration of the warrantyperiod. There is absolutelyno warrantyon software and allsoftware products are sold asa user
license under the termsof the software license agreement included with the product. The Customer assumesallresponsibility for the proper selection,
installation, operation and maintenance of any productspurchased fromJCI . Custom productsare onlywarranted to the extent that theydo not func-
tion upon delivery. In such cases, JCI can replace or credit at itsoption.
International Warranty
The warrantyfor internationalcustomers isthe same asfor anycustomer within Canada and the United States, with the exception that JCI shallnot be
responsible for anycustomsfees, taxes, or VAT that maybe due.
Warranty Procedure
To obtain service under thiswarranty, please return the item(s) in question to the point of purchase. Allauthorized distributorsand dealershave a war-
rantyprogram. Anyone returning goodsto JCI must first obtain an authorization number. JCI will not accept anyshipment whatsoever for which prior
authorization hasnot been obtained.
Conditions to Void Warranty
Thiswarrantyappliesonlyto defectsin partsand workmanship relating to normaluse. It doesnot cover:
damage incurred in shipping or handling;
l
damage caused bydisaster such asfire, flood, wind, earthquake or lightning;
l
damage due to causesbeyond the controlof JCI such asexcessive voltage, mechanicalshockor water damage;
l
damage caused byunauthorized attachment, alterations, modificationsor foreign objects;
l
damage caused byperipherals(unlesssuch peripheralswere supplied byJCI.);
l
defectscaused byfailure to provide a suitable installation environment for the products;
l
damage caused byuse of the productsfor purposesother than those for which it wasdesigned;
l
damage fromimproper maintenance;
l
damage arising out of anyother abuse, mishandling or improper application of the products.
l
Items Not Covered by Warranty
In addition to the itemswhich void the Warranty, the following itemsshall not be covered byWarranty: (i) freight cost to the repair centerre; (ii) products
which are not identified with JCI'sproduct labeland lot number or serial number; (iii) productsdisassembled or repaired in such a manner asto adversely
affect performance or prevent adequate inspection or testing to verifyanywarrantyclaim. Accesscardsor tagsreturned for replacement under warranty
willbe credited or replaced at JCI's option. Productsnot covered bythis warranty, or otherwise out of warrantydue to age, misuse, or damage shall be
evaluated, and a repair estimate shall be provided. No repair work willbe performed until a valid purchase order is received from the Customer and a
Return Merchandise Authorization number (RMA) isissued byJCI'sCustomer Service.
JCI'sliabilityfor failure to repair the product under thiswarranty after a reasonable number of attemptswillbe limited to a replacement of the product, as
the exclusive remedyfor breach of warranty. Under no circumstances shallJCI be liable for anyspecial, incidental, or consequential damages based
upon breach of warranty, breach of contract, negligence, strict liability, or any other legal theory. Such damagesinclude, but are not limited to, loss of
profits, lossof the product or anyassociated equipment, cost of capital, cost of substitute or replacement equipment, facilitiesor services, down time, pur-
chaser'stime, the claimsof third parties, including customers, and injuryto property. The lawsof some jurisdictionslimit or do not allow the disclaimer of con-
sequentialdamages. If the laws of such a jurisdiction apply to any claimbyor against JCI, the limitations and disclaimerscontained here shall be to the
greatest extent permitted bylaw. Some statesdo not allow the exclusion or limitation of incidentalor consequentialdamages, so that the above may not
applyto you.
Disclaimer of Warranties
Thiswarranty containsthe entire warranty and shallbe in lieu of anyand allother warranties, whether expressed or implied (including all implied war-
rantiesof merchantabilityor fitnessfor a particular purpose) and of allother obligations or liabilitieson the part of JCI. JCI neither assumes responsibility
for, nor authorizesanyother person purporting to act on itsbehalf to modify or to change thiswarranty, nor to assume for it anyother warrantyor liability
concerning thisproduct. Thisdisclaimer of warrantiesand limited warrantyare governed bythe lawsof the province of Ontario, Canada.
JCI recommendsthat the entire systembe completely tested on a regular basis. However, despite frequent testing, and due to, but not limited to, crim-
inaltampering or electricaldisruption, it ispossible for thisproduct to failto performasexpected.
Installer's Lockout
Anyproductsreturned to DSC which have the Installer'sLockout option enabled and exhibit no other problemswillbe subject to a service charge.
Out of Warranty Repairs
JCI willat itsoption repair or replace out-of-warrantyproducts which are returned to its factoryaccording to the following conditions. Anyone returning
goods to JCI must first obtain an authorization number. JCI will not accept any shipment whatsoever for which prior authorization has not been
obtained.
Productswhich JCI determinesto be repairable will be repaired and returned. A set fee which JCI has pre-determined and which may be revised from
time to time, willbe charged for each unit repaired.
Productswhich JCI determinesnot to be repairable willbe replaced by the nearest equivalent product available at that time. The current market price of
the replacement product willbe charged for each replacement unit.
Note to Installers
Thiswarning contains vitalinformation. As the onlyindividual in contact with systemusers, it isyour responsibility to bring each itemin this warning to the
attention of the usersof thissystem.
System Failures
Thissystemhasbeen carefullydesigned to be aseffective aspossible. There are circumstances, however, involving fire, burglary, or other typesof emer-
gencieswhere it maynot provide protection. Anyalarm systemof anytype maybe compromised deliberatelyor mayfailto operate asexpected for a vari-
etyof reasons. Some but not allof these reasonsmaybe:
Inadequate Installation
Asecuritysystemmust be installed properlyin order to provide adequate protection. Everyinstallation should be evaluated by a securityprofessional to
ensure that allaccess points and areas are covered. Locks and latches on windows and doorsmust be secure and operate as intended. Windows,
doors, walls, ceilings and other building materials must be of sufficient strength and construction to provide the level of protection expected. A ree-
valuation must be done during and after anyconstruction activity. An evaluation bythe fire and/or police department ishighlyrecommended if thisservice
isavailable.
