Purchaser understands and acknowledges thatthegoods sold here arewine cellars, cigar h umidors, and/or other
similar units which h ouse w ine orcigars. Purchaser assumes allrisk ofusing t hese units, including risk ofspoilage,
humidity variations, temperature variations, leaks, fire,water damage, mold, mildew, dryness and similar and any
other p erils t hatmight occur.
Seller isnotresponsible forincidental orconsequential damages, and there arenowarranties, expressed orimplied,
which e xtend b eyond theLimited Warranty described above. The implied warranties ofmerchantability and offitness
foraparticular purpose arehereby expressly disclaimed. Some s tates d onotallow theexclusion ofincidental or
consequential damages, orawaiver oftheimplied warranties offitness a nd/or merchantability, sotheabove
]imitations may not a pply t oyou. T his warranty gives y ou specific legal rights a nd youmay also have other r ights
which v ary from state tostate.
Intheevent ofany dispute between Seller and Purchaser arising o utoforrelating tothese t erms a nd conditions or
tothegoods sold generally, Purchaser must firstfileawritten c laim with Seller within tendays o ftheoccurrence
giving rise totheclaim and wait a nadditional thirtydays f oraresponse before initiating any legal action. The sale
and allterms a re subject toCalifornia law.Any legal proceeding arising o ut o forrelating tothese t erms a nd
conditions ortothegoods s old generally shall b ebrought solely a nd exclusively intheCounty ofLos Angeles. Inno
event may Purchaser initiate a nylegal proceeding more than sixmonths after t heoccurrence oftheevent giving rise
tothedispute.
The above t erms a nd conditions are theonly ones g overning thistransaction and Seller makes nooral
representations ofanykind. T hese Terms a nd Conditions can only bemodified inwriting, signed byboth Purchaser
and Seller.
