f. Other Licenses. Your use of software applications installed on the xSeries 150
may require additional licenses -- please consult the license agreement
accompanying such software.
g. Reservation of Rights. Manufacturer, and MS and its suppliers (including
Microsoft Corporation), reserve all rights not expressly granted to you in this
EULA.
2. ADDITIONAL SOFTWARE. Any Microsoft software provided to you by
Manufacturer, MS or Microsoft Corporation that updates or supplements the
original Product is governed by this EULA, unless other terms are provided with
such updates or supplements.
3. TRANSFER— Transfer to Third Parties. You may permanently transfer all of your
rights under this EULA only as part of a sale or transfer of the xSeries 150,
provided you retain no copies, you transfer all of the Product (including all
component parts, the media and printed materials, any upgrades, this EULA and,
if applicable, the Certificate(s) of Authenticity), and the recipient agrees to the
terms of this EULA. No Rental. You may not rent, lease, or lend the Product
except as expressly permitted as part of the xSeries 150 Appliance agreement.
4. LIMITATION ON REVERSE ENGINEERING, DECOMPILATION, AND
DISASSEMBLY. You may not reverse engineer, decompile, or disassemble the
Product, except and only to the extent that it is expressly permitted by applicable
law notwithstanding this limitation.
5. NOT FAULT TOLERANT. THE PRODUCT MAY CONTAIN TECHNOLOGY
THAT IS NOT FAULT TOLERANT AND IS NOT DESIGNED,
MANUFACTURED, OR INTENDED FOR USE IN ENVIRONMENTS OR
APPLICATIONS IN WHICH THE FAILURE OF THE PRODUCT COULD LEAD
TO DEATH, PERSONAL INJURY, OR SEVERE PHYSICAL OR
ENVIRONMENTAL DAMAGE.
6. TERMINATION. Without prejudice to any other rights, Manufacturer and/or
MS may cancel this EULA if you do not abide by the terms and conditions of this
EULA, in which case you must destroy all copies of the Product and all of its
component parts.
7. CONSENT TO USE OF DATA. You agree that Manufacturer, MS and/or
Microsoft Corporation (and/or their subsidiaries, affiliates, and agents) may
collect and use technical information you provide as a part of support services
related to the Product. Manufacturer, MS and/or Microsoft Corporation (and/or
their subsidiaries, affiliates, and agents) agree not to use this information in a
form that personally identifies you.
8. NOT FOR RESALE SOFTWARE. Product identified as "Not for Resale" or "NFR,"
may not be resold, transferred or used for any purpose other than demonstration,
test or evaluation.
9. BACK-UP COPY. If Manufacturer has not included a back-up copy of the
Product with the xSeries 150, you may make a single back-up copy of the Product.
You may use the back-up copy solely for archival purposes.
10. SINGLE COMPUTER. The Product is licensed with the xSeries 150 as a single
integrated product. The Product may only be used with the xSeries 150, except as
expressly provided in this EULA.
11. LEASED HARDWARE. In the event that you receive the xSeries 150 under the
terms of a lease from Manufacturer or Manufacturer's third-party representative,
the following additional terms shall apply: (i) you may not transfer the Product to
another user as part of the transfer of the xSeries 150, whether or not transfer of
the Product with the xSeries 150 is otherwise allowed in this EULA; (ii) your
rights with respect to any Product upgrades shall be as determined by the lease
you signed for the xSeries 150; and (iii) you may not use the Product after your
lease terminates, unless you purchase the xSeries 150 from Manufacturer.
