These terms and conditions constitute the entire agreement between licensor (and its licensors,
including their licensors and suppliers) and you pertaining to the subject matter hereof, and supersedes
in their entirety any and all written or oral agreements previously existing between us with respect to
this subject matter.
DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY. : EXCEPT AS SET FORTH IN THE

of profits or savings, downtime, damage to or replacement of equipment and property, or recovery or
replacement of programs or data) arising from claims based in warranty, contract, tort (including
negligence), strict liability, or otherwise even if Licensor or its third-party supplies have been advised of
the possibility of such claim or damages. The liability of Licensor and its third-party suppliers (and
their third-party suppliers) for damages shall not exceed the actual amount paid for the GPS receiver
product.
Some countries do not allow the exclusion of limitation of implied warranties or liability for incidental or
consequential damages, so the above limitations or exclusions may not apply to you.
Warning. The Software may contain inaccurate or incomplete information due to the passage of time,
changing circumstances, sources used and the nature of collecting comprehensive geographic data, any
of which may lead to incorrect results.

sur une carte et de faire appel a son bon sens.

1. GARANTIE MAGELLAN
Magellan garantit que ses recepteurs GPS et accessoires sont exempts de detauts materiels et de fabrication et sont
conformes aux specifications du produit publiees par ses soins pour une periode de un an a compter de la date initiale de
I'achat. LA PRESENTE GARANTIE S'APPLIQUE UNIQUEMENT

L'ACHETEUR ORIGINAL DE CE PRODUIT.
En cas de defaut, Magellan decidera, a sa seule discretion, de reparer ou de remplacer I'appareil sans facturer a I'acheteur
les pieces ou la main-d'ceuvre. Le produit remplace ou repare sera garanti pour une peri ode de 90 jours a compter de la date
de renvoi ou pour Ie reste de la duree de garantie originale, selon la duree la plus longue.
Magellan garantit que Ie support des produits logiciels ou du logiciel inclus dans I'appareil sont exempts de defauts pour une
periode de 30 jours, a compter de la date d'expedition et sont, pour I'essentiel, conformes a la documentation de I'utilisateur
alors en vigueur, fournie avec Ie logiciel (y compris les mises a jour de celui-ci). La seule obligation de Magellan consiste a
rectifier ou a remplacer les supports ou Ie logiciel de maniere a ce qu'ils soient, pour I'essentiel, conformes a la
documentation de I'utilisateur alors en vigueur. Magellan ne garantit pas que Ie logiciel sera conforme aux exigences de
I'acheteur, ni que son fonctionnement sera ininterrompu, infaillible ou exempt de virus. L'acheteur utilise ce logiciel sous sa
seule responsabilite.

3. OBLIGATIONS DE L'ACHETEUR
S'il souhaite s'adresser au service apres-vente, I'acheteur doit obtenir un numero d'Autorisation de retour de materiel (RMA)
aupres de l'Assistance technique de Magellan avant I'expedition, en appelant au +866 (868)-2259-909 (Etats-Unis) ou en
envoyant un e-mail amagellansupport@magellanGPS.com. L'acheteur doit retourner Ie produit a ses frais avec une copie de
la facture originale, en mentionnant I'adresse de retour ainsi que Ie numero RMA clairement inscrit a I'exterieur de
I'emballage a I'adresse du Centre de service apres-vente agree Magellan fournie par Magellan avec Ie numero RMA.
Magellan se reserve Ie droit de refuser d'assurer gratuitement Ie service apres-vente si la facture n'accompagne pas Ie
produit, si les informations contenues sont incompletes ou illisibles, ou si Ie numero de serie a ete modifie ou efface.
Magellan ne pourra etre tenu responsable d'aucune perte ou dommage du produit lors de son transit ou de son expedition
pour reparation. La souscription a une assurance est vivement conseillee. MAGELLAN VOUS CONSEILLE D'UTILISER UNE
METHODE D'EXPEDITION ASSURANT LE SUIVI DE VOTRE COLIS, COMME UPS OU FEDEX, LORSQUE VOUS RENVOYEZ
UN PRODUIT.
4. LIMITATION DE GARANTIE IMPLICITE

5. EXCLUSIONS
Ne sont pas couverts par la garantie :
(1) I'entretien periodique et la reparation ou Ie remplacement de pieces lies a I'usure ou aux dommages normaux ;
(2) les piles;
(3) les finitions ;
(4) les installations ou les dysfonctionnements lies a I'installation ;
(5) tout dommage cause par
(i)
I'expedition, une mauvaise utilisation, une utilisation abusive, la negligence, une
manipulation intempestive, I'humidite, Ie contact avec des liquides, la proximite d'une source de chaleur ou I'exposition a
une source de chaleur ou une utilisation incorrecte ; (ii) les catastrophes telles que les incendies, les inondations, Ie vent et
la foudre ; (iii) les branchements non autorises ou les modifications;
(6) les reparations effectuees ou tentees par toute personne etrangere a un Centre de service apres-vente Magellan agree;
(7) tout produit, composant ou piece non fabrique par Magellan,
(8) Ie fait que Ie recepteur ne fera pas I'objet d'une action en contrefa~on de brevet, marque commerciale, droit d'auteur
ou autre droit de propriete, y compris les secrets commerciaux ;
