Article 4. No Warranty
YOU UNDERSTAND THAT ANY SOFTWARE HEREUNDER IS
BEING PROVIDED TO YOU ON AN "AS IS" BASIS, AND FUJITSU
EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR
IMPLIED, INCLUDING, WITHOUT LIMITATION, ALL WARRANTIES
OF NON-INFRINGEMENT, MERCHANTABILITY AND/OR FITNESS
FOR A PARTICULAR PURPOSE.
FUJITSU does not warrant that any Software hereunder will
operate in combination with your hardware, software, systems or
data. You hereby waive any claim against FUJITSU for any loss or
damage that you may incur related to the Software. In no event will
FUJITSU be liable for any direct, indirect, incidental or
consequential damages (including, but not limited to, loss of
profits, interruption of business, loss of business information and
other pecuniary damage) resulting from or arising out of the use or
inability to use the Software even if FUJITSU has been advised of
the possibility of such damages.
Article 5. Termination of License
(1) If you violate the terms of this license or perform unlawful or
unreasonable acts, this license will terminate with immediate
effect.
(2) If this license is terminated as a result of the clause (1) above,
you must immediately stop using the Software, return the F-
022 mobile phone product to FUJITSU or any party specifically
designated by FUJITSU, as the liquidated damages for such a
violation, return the Bundled Software and its backup copy to
FUJITSU or any party specifically designated by FUJITSU, and
delete the Bundled Software from your personal computer in a
non-recoverable manner.
Article 6. Others
The specifications of the Software are subject to change without
notice.
