TiVo Basic Service Agreement

Welcome to TiVo and the TiVo Basic service! This agreement explains
the terms and conditions that will apply to your use of the TiVo Basic
service and constitutes a legally binding agreement between you and
TiVo Inc. ("TiVo"). By using the TiVo Basic service, you agree to all the
terms and conditions in this agreement ("Agreement").
The TiVo Basic Service and the Privacy Policy
1. The TiVo logo on your

(referred to in this TiVo Basic Service
Agreement as your "TiVo DVR") means that it can receive the TiVo
Basic service offered and provided by TiVo for personal, non-
commercial use. Your activation and continued use of the TiVo
Basic service is subject to the terms and conditions of this
Agreement. TiVo may at its discretion change the terms of this
Agreement. Such changes shall be effective upon notification by
TiVo. We encourage you to check www.tivo.com/privacy or call us
for a copy of the current TiVo Basic service agreement.
2. The TiVo Basic service consists of

hard disk drive recording, (b) manual recording by time & channel,
and (c) controlling live TV. Each of these features is part of the
"TiVo Basic service." The "TiVo Basic service" means these
features and any additional features and functionality that TiVo may
at its discretion and from time to time offer.

Changes to Your TiVo Basic Service.

functionality of the TiVo Basic service or the TiVo DVR without
notice. TiVo reserves the right to discontinue one, some, or all of the
features of the TiVo Basic service you receive at any time at its
discretion. TiVo may at its discretion discontinue the provision of
software updates to certain TiVo DVRs. This means that while other

TiVo DVRs may receive continued software updates and
functionality; TiVo is not required to provide such updates to your
TiVo DVR. Additionally, the level of service TiVo provides may not
be the same on each TiVo DVR; a given TiVo DVR may support
different features and functionality, and TiVo is under no obligation
to provide all features and functionality to your TiVo DVR.
TiVo respects the privacy of your User
TiVo's Privacy Policy.
Information (as defined in TiVo's Privacy Policy) and will not
disclose any of your User Information except as permitted in TiVo's
Privacy Policy. A copy of TiVo's Privacy Policy is included in the
product manual and the latest version can always be found via our
web site at www.tivo.com/privacy. Please read it carefully before
using the TiVo Basic service. By using the TiVo Basic service, you
agree to the terms and conditions of our Privacy Policy and affirm
that you understand the options TiVo provides to you with regard to
your User Information. TiVo will notify you of any substantial and
material changes to the Privacy Policy and the latest Privacy Policy
can always be accessed through our web site at www.tivo.com/
privacy.
THE PROVISION OF SECTIONS 5, 6, AND 7 OF THE
NOTE:
TIVO PLUS SERVICE AGREEMENT ARE PART OF THIS
AGREEMENT AND ARE HEREBY EXPRESSLY
INCORPORATED BY REFERENCE. ANY REFERENCE TO
"TIVO PLUS" IN SUCH SECTIONS IS REPLACED WITH "TIVO
BASIC" FOR PURPOSES OF THIS AGREEMENT. THESE ARE
MATERIAL PROVISIONS AFFECTING YOUR RIGHTS.
