7) WARRANTY

Article 6: Guarantees - Warranty
6.1 Statutory guarantee of conformity and statutory guarantee covering hidden defects
a. In accordance with applicable law and regulations, Kangui guarantees the conformity of products ordered
by the Customer, by which products must conform to their intended use and the description provided on
the website, and guarantees the Customer against hidden defects in products ordered, where such hidden
defects, present on the purchase date, render the products unfit for their intended purpose.
b. In accordance with Article L. 217-12 of the French Consumer Code, the statutory guarantee of conformity,
which is limited to the normal use of products, is available to the Customer for a period of two (2) years from
delivery of the product, on the basis that non-conformities shall be presumed to have existed during the
twenty-four (24) months since delivery of the item and it is for the seller to prove otherwise in such cases.
c. In accordance with Article 1641 et seq of the French Civil Code, the statutory guarantee for hidden defects,
which is limited to (i) a hidden fault, i.e. one which was not visible at the time of purchase, (ii) present at
the time of purchase and (iii) rendering the product unfit for its intended purpose or greatly limits its use, is
available to the Customer for a period of two (2) years from when the hidden defect was discovered. The
customer then has the choice between:
• keeping the item and requesting a price reduction, or
• returning the product and request a refund of the purchase price as well as charges related to the sale.
Details of the application procedure:
- the Customer has a period of two (2) years from the date of delivery in which to take action;
- the Customer may opt for repair or replacement of the item, subject to the cost conditions stipulated in
Article L.217-9 of the French Consumer Code;
- the Customer is exempt from the requirement to prove that the non-conformity of the item was present during
the twenty-four (24) months after delivery of the item. For used goods, this period is six (6) months.
- the statutory guarantee of conformity applies irrespective of any form of commercial warranty;
- the Customer may opt to invoke the guarantee against hidden defects for the good sold as defined by Article
1641 of the Civil Code; in this case, he/she may choose either to cancel the purchase or request a reduction in
price under Article 1644 of the French Civil Code.

Article L. 217-4 of the French Consumer Code:
«The seller shall deliver a good in accordance with the contract and is responsible for any non-conformities
present at the time of delivery. The seller is also responsible for non-conformities relating to the packaging,
assembly instructions and, where it has been required to do so under the contract or has been carried out under
its responsibility, installation.»
Article L. 217-5 of the French Consumer Code:
«The good conforms to the contract if:
1. It is fit for the use typically expected of an equivalent good and, where applicable:
- it matches the description provided by the seller and possesses the qualities demonstrated by the seller to
the buyer in the form of a sample or model;
- it demonstrates qualities that a buyer may reasonably expect in view of public declarations by the seller,
manufacturer or its representative, such as through advertisements or labelling; or
2. it features characteristics established by mutual agreement of the parties or is fit for any specific use sought by
the buyer, of which the seller has been made aware and to which the seller has agreed».
