9 WARRANTY
STANDARD LIMITED WARRANTY & LIABILITY AGREEMENT
Upon purchase of this equipment, the user agrees to the following terms, conditions, and
limitations of warranty and liability coverage:
ProFlo Inc. warrants its trade customers that ProFlo Product(s) System(s) and Components
[hear after referred to as Product(s)] will be free from any original defects in materials and
workmanship for a period of one year. During the warranty period, ProFlo will repair or
replace, at its option, Product(s) and or parts found to be defective under normal use, only
when the Product is installed and operated in accordance with ProFlo's installation
instructions, operation manual and within good engineering practices. ProFlo's liability is
limited solely to the replacement or repair of defective Product(s). There are no other
expressed warranties, implied or stated obligations by ProFlo to cover other expenses
related to the Products' repair.
The operation of any ProFlo Product(s) outside the scope of ProFlo's stated operation
specifications, including but not limited to fluids or processes not compatible with the
Product's materials of construction and or operated at pressures and temperatures outside
the stated operating specification ranges of the Product(s) will void this warranty. In
addition, any modifications to Product(s) not authorized in writing by ProFlo will void this
warranty and place the user in the position of liability for any malfunction of the
Product(s). Any filter pre-screen or primary screen that has become "plugged" with debris
is not considered defective and is expressly not covered under this warranty.
It is the obligation of the customer to return any Product(s) that is considered defective at
their expense to ProFlo's address indicated below; i.e., ALL from and to warranty freight
charges are the responsibility of the customer.
ProFlo is not liable for any indirect, incidental or consequential damage in connection with
the use of ProFlo Product(s), including but not limited to, vegetation loss, the cost of
substitution product(s) or service during the periods of malfunction or resulting non-use,
cost of labor, property damage or personal injury resulting from user/installer negligence.
This warranty is not deemed to be a consumer warranty and does not extend to anyone
other than those customers who purchase ProFlo Product(s) for commercial use or resale.
THIS WARRANTY IS GIVEN EXPRESSLY AND IN PLACE OF ALL OTHER EXPRESS OR IMPLIED
WARRANTIES INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF
MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND THIS WARRANTY IS
THE ONLY WARRANTY MADE BY PROFLO.
