End User License Agreement
This End User license Agreement ("Agreement~)
is an agreement between FUJIFILM Corporation
("FUJIFILM") and you. which sets forth the terms and
conditions of the license granted for you to use the
software provided
by
FUJIFILM.
The CD-ROM contains third-party software. In case
a separate agreement is provided by a third party
supplier for its software. the provisions of such
separate agreement shall apply to the use of such
third party software. prevailing over those of this
Agreement

Definltlon~.
(a) "Media" means the CD-ROM titled 'Software for
FinePix' which is provided to you together with this
Agreement
(b) "Software" means the software which is
recorded on Media.
{cl MDocumentation W means the operation manuals
of Software and other related written materials
which are provided to you together with Media.
(d) MProduct" means Media (including Software)
and Documentation collectively.

Ce Contrat de Licence d'Utilisateur (c Contrat ») est un accord
entre FUJIFllM Corporation (c FUJI FILM ») et vous-meme, qui
definit Ies termes et conditions de la cession qui vous est
accordee pour l'utiHsarion du Jogiciel fourni par FUJJFJlM.
le CD-ROM contient Ie logiciel d'une tierce personne.
Dans Ie cas ou un cant rat separe est fourni par ta tierce
per sonne pour son logiciel.les provisions prevues dans
ce contrat separe entrenr en applicarion pour I'utilisation
du logiciel de la Tierce personne, et ces provisions
prevalent sur celles prevues dans ce Contrat.

(a) ,. Media. signifie Ie CD-ROM intitule,. Software for
FinePix ,. qui vous est fourni avec ce Contrar

Logiciel ,. signifie Ie logiciel qui est enregistre sur
Ie Media.

Este contrata de autorizaci6n del usuario ("Contrato·) es
un contrato entre FUJIFILM Corporation {"FUJI FILM") y
uSted. en el que se establecen los terminos y condiciones
de la autorizaci6n que se Ie concede para el usa del
software suministrado por FUJIFILM.
EI CD-ROM contiene un software de terceros. En caso
de que se realice un contrato por separade por un
tercer proveedor para su software, las provisiones de
tal contrato par separado serim aplicadas al uso del
software de dicho tercero, prevaleciendo sobre el
presente contrato.

(a) EI "Soporte· es el CD-ROM titulado ·Software for
FinePix

que se Ie entrega a usted junto con este
contra to.
(b) MSoftware" es el software que esta grabado en el
soporte.
(c) La MDocumentaci6n

son los manuales donde
se ex plica el funcionamiento del software y
demi3s materiales relativos al mismo que se Ie
suministran a usted junto con el soporte.
(d) EI 'Producto" es el saporte (incluyendo el software)
junto con la documentaci6n.
2. U~e of Software.
FUJIFllM grants to you a nontransferable.
nonexclusive license:
(a) to install one copy of Software onto one
computer in binary machine executable form;
(b) to use Software on the computer onto which
Software is installed; and
(c) to make one backup copy of Software.
1. R.~trietlon~.
3.1
You shall not distribute, rent, lease or otherwise
transfer all or any part of Software, Media or
Documentation to any third party without
FUJIFllM's prior written consent. You also shall
not sublicense. assign or otherwise transfer all or
any part of the rights granted to you by FUJI FILM
under this Agreement without FUJIFllM's prior
written consent.
3.2 Except as expressly granted by FUJIFILM
hereunder, you shall not copy or reproduce all or
any part of Software or Documentation.
3.3
You shall not modify, adapt or translate Software
or Documentation. You also shall not alter
or remove copyright and other proprietary
nmices that appear on or in Sohware or
Documentation.
3.4 You shall not, or shall not have any third party,
reverse-engineer, decompile, or disassemble
Software.
4, Ownership.
All copyrights and other proprietary rights to
Software and Documentation are owned and
retained by FUJIFILM or the third party suppliers
as indicated on or in Software
or
Documentation.

FUJI FILM vous accorde une cession non transferable et
non exclusive:
(a) pour installer une copie du logiciel sur un
ordinateur et sous forme d'execution en machine
binaire;
(b) pour utiliser Ie Logiciel sur I'ordinateur sur lequelle

(c) pour reaJiser une cepie de secours du Logiciel.
3. lestrictions.
3.1 Vous ne pouvez en aucun cas distribuer, preter,
louer ou encore transferer tout ou une partie du
Logiciel, du Media ou de la Documentation
a
un
tiers sans I'accord prealable ecrit de FUJJF1LM. Vous
ne pouvez en aucun cas non plus ceder, assigner
ou encore transferer tout ou une partie des droits
qui vous sont accordes par FUJIFILM sous ce
(ontrat sans accord ecrit prealable de FUJIFILM.
3.2 Sauf dans les seuls cas expressement defmis pal
FUJIFILM ci-dessous, vous ne pouvez en aucun
cas copier ou reproduire en partie ou en totalite Ie
Logiciel ou la Documentation.
3.3
Vous ne pouvez en aucun cas modifier, adapter ou
traduire Ie Logiciel ou la Documentation. Vous ne
pouvez en aucun cas alterer au retirer Ie copyright
et toute autre notice de propriete Qui apparait sur Ie
Logiciel ou dans la Documentation.
3.4
Vous ne pouvez en aucun cas realiser vous
meme ou demander
a
un tiers de realiser une
re-decomposition, une decompilation, ou un
desassemblage du Logiciel.
4, Proprlete.
Tous les droits d'auteur et autre droits de propriete
du Logiciel et de la Documentation sont possedes et
conserves par FUJIFILM au ses fournisseurs tiers tels

FUJIFllM Ie concede una autarizaci6n intransferible y
no exclusiva:
(a) para instalar una copia del software en un
ordenador en la forma de ejecuci6n binaria del

forma de transferencia de cualquier parte del
software, sapone 0 documentaci6n a terceros
sin el consentimiento por escrito de FUJIFILM.
Usted tampoco puede conceder autorizaci6n,
asignar ni transferir de cualquier otra forma, ni
total ni parcial mente, de los derechos que Ie
concede a usted FUJIF'LM bajo las condiciones
del presente contrate sin el consentimiento
previo por escrito de FUJI FILM.
3.2 Queda prohibido copiar 0 reproducir, total 0
parcialmente. el software y la documentaci6n,
salvo autorizaci6n expresa de FUJIFILM.
3.3
Queda prohibido modificar, adaptar 0 traducir el
software 0 la documentaci6n. Queda prohibido
igualmeme alterar 0 eliminar los avisos y notas
sobre derechos reservados que aparecen en el
software 0 en la documentaci6n.
3.4 Queda prohibido, tanto por parte de usted
como de terceros, mediante ingenieda inversa,
descompilar a desinstalar el software.

Todos los derechos reservados y otras derechos de
propiedad del software y la documentaci6n son
Nothing contained herein shall be construed,
expressly or implicitly, as transferring or granting
any right, license, or title to you other than those
explicitly granted under this Agreement.
S. Limited Wilrranty.
FUJI FILM warrants to you that Media is free from
any defect in material and workmanship under
normal use for ninety (90) days from the date of
your receipt of Media. Should Media not meet
the foregoing warranty, FUJI FILM shall replace
such defective Media with other Media bearing
no defect. FUJI FilM's entire liability and your sole
and exclusive remedy with regard to any defect in
Media shall be expressly limited to such FUJIFILM's
replacement of Media as provided herein
6. DISCLAIMER OF WARRANTY.
EXCEPT AS PROVIDED IN SECTION SHEREIN,
FUJIFllM PROVIDES PRODUCT 'AS IS' AND WITHOUT
WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
FUJIFllM SHAll MAKE NO WARRANTY, EXPRESS,
IMPLIED OR STATUTORY, AS TO ANY OTHER
MATTERS, INCLUDING, BUT NOT LIMITED TO NON·
INFRINGEMENT OF ANY COPYRIGHT, PATENT, TRADE
SECRET, OR ANY OTHER PROPRIETARY RIGHTS OF
ANYTHIRD PARTY, MERCHANTABILITY, OR FITNESS
FOR ANY PARTICULAR PURPOSE.
1, LIMITATION OF LIABILITY,
IN NO EVENT SHAll FUJIFllM HAVE ANY LIABILITY
FOR ANY GENERAL, SPECIAL, DIRECT, INDIRECT,
CONSEQUENTIAL, INCIDENTAL, OR OTHER
DAMAGES (INCLUDING DAMAGES FOR lOSS OF
PROFITS OR lOST SAVINGS) INCURRED FROM THE
USE OF OR INABILITY TO USE PRODUCT EVEN IF

Au cas

Ie Media ne remplirair pas les conditions
de garantie speciliees, FUJIFILM remplacera Ie Media
defectueux par un Media ne contenant pas de defaut.
l'entiere responsabilite de FUJIFILM ainsi que votre
seul et exclusif recours concernant tout defaut dans Ie
Media se Iimitent expressement au rem placement par
FUJI FILM du Media tel Qu'indique iei.
6. DINI DE RESPONSAllllTE,

contrato.
S. Garantialimitada.
FUJIFILM Ie garantiza que el soporte esta exento de
cualquier defecto en material
y
mano de obra bajo
un uso normal durante noventa (90) dfas a partir
del momento de la recepci6n por su parte de dicho
soporte. Si el soporte no cum pie con los terminos
de esta garantfa, FUJIFtLM Ie sustituira el soporte
defectuoso por otro que no contenga ningun
defecto. Toda la garantia que concede FUJIFILM y su
unico y exclusivo derecho con respecto a cualquier
defecto del soporte queda expresamente limitado a
la sustituci6n por parte de FUJIFILM del soporte que
se Ie suministra junto con este contrato.

8. No export.
You acknowledge that neither Software nor any
part thereof,
will
be transferred, or exported to
any country or used in any manner in violation of
any export control laws and regula lions to which
Software is subject.
9.
Termination.
In case you breach any of the terms and conditions
hereof. FUJIFILM may immediately terminate this
Agreement without any notice.
10.Tenn.
This Agreement is effective until the date when you
cease to use Software, unless earlier terminated in
accordance with Section 9 hereof.
11. Obligation upon 1erminiltlon.
Upon termination or expiration of this Agreement,
you shall, at your own responsibility and expense,
delete or destroy immediately all Software
(including its copies), Media and Documentation.
12.GoYerning Law.
This Agreement shall be governed by and
construed in accordance with laws of Japan.

Vous reconnaissez Que ni Ie Logiciel ni une partie de
ce dernier, ne sera transfere ou exporte dans un pays
quelconque, ou ne sera utilise en aucune fa\on en
violation des lois de contrele d'exportation et de la
reglementation auxquelJes Ie Logiciel est soumis.
9. Fin dll cont"t.
En cas d'infraction d'un quelconque terme
et
d'une
quelconque condition ci dec rites, FUJIFILM pourra
terminer immediatement ce (ontrat avec vous sans
avertissement prealable.
lO.Terme.
Ce Contrat est effectif jusqu'a ce que vous
cessiez d'utiliser Ie logiciel,

moins qu'i' ne soit
prealablement interrompu en accord avec la Section
9
ci-decrite.
11.0bllgatlon Ion de la tfrmlnaison,
Lors de la terminaison ou de I'expiration de ce Contrat,
vous devrez, sous votre responsabilite et avos propres
frais, effacer ou detruire immediatement tout Ie
Logiciel (y compris ses copies), Ie Media ainsi que la
Documentation.

Ce Contrat est gouverne par et en accord avec les lois
en vigueur au Japan.

Usted acepta que ni el software ni ningun otro
elemento de los aquf mencionados, seran transferidos
ni exportados a ningun otro pais, ni utilizados de
manera que violen las leyes de control de la exportaci6n
y las normas a las que esta sujeto el software.
9. Rfscision.
En case de incumplimiento de cualquiera de los
terminos y condiciones aqui establecidos, FUJIFILM
puede rescindir inmediatamente este conHato sin
previo aviso.
10.Duraci6n.
Este contrato estara vigente hasta la fecha en que
cese por su parte el uso del software, a menos que
haya sido rescindido de acuerdo con el punto 9
anterior.
11.0bllgaclonf~trl~ la re~ci~lon.
A la rescisi6n 0 expiraci6n de este contrato,
debera usted, bajo su propia responsabilidad y
a su costa, borrar 0 destruir inmediatamente el
software (incluyendo sus copias), el soporte y la
documentaci6n.
12.Jurisdicci6n.
Este contrato queda sometido y sera interpretado
de acuerdo con las leyes de Jap6n.
