SCOPE OF WARRANTY: Pulse Biotech, LLC ("Pulse") warrants to the original end user customer that the
Pulse Xyleject Injection System will be free from substantial defects in materials or workmanship as follows:
o The device power unit is warranted for up to 6 months from date of purchase.
o No warranty is extended on the vest or on any parts subject to replacement under standard
maintenance such as O-Rings, hoses, and seals. No warranty is extended on the Conical Needle and
Holding Compartment, as these are consumable items.
o Warranty is VOID if appropriate care and maintenance procedures are not followed.
LIMITATIONS OF WARRANTY:
The system and all components must be properly used only for the intended purpose (grapevine injections) in
accordance with the standard operating instructions, and must be properly maintained in accordance with the
standard maintenance requirements.
In the event of a warranty claim, and to the fullest extent allowed by local law, the original end user customer's
sole and exclusive remedy for the warranty claim is to obtain the following warranty service from Pulse Biotech,
LLC:
o Pulse must receive notice of the warranty claim (by telephone, mail or e-mail) from the end user
customer within the applicable warranty period.
o Pulse must verify the warranty claim. (Actual testing may be necessary for verification of the system or
component).
o The end user customer must return to Pulse the system or component the end user customer claims to
be defective, and Pulse must confirm the claimed defect.
o Any replacement system or component will be invoiced to the end user customer, but the invoice will be
canceled upon receipt of the end user customer's system or component & confirmation of the claimed
defect.
EXCEPT AS EXPRESSLY STATED ABOVE, NEITHER PULSE BIOTECH, LLC NOR ANY THIRD PARTY
SUPPLIER MAKES ANY REPRESENTATIONS OR WARRANTIES AS TO ANY PRODUCT OR
COMPONENT, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF
MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ALL OF WHICH ARE HEREBY
EXPRESSLY DISCLAIMED AND EXCLUDED. IN NO EVENT SHALL PULSE BIOTECH OR ANY THIRD
PARTY SUPPLIER BE LIABLE FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR
EXEMPLARY DAMAGES FOR BREACH OF EXPRESS WARRANTIES OR FOR DESTRUCTION OF OR
INJURY (INCLUDING DEATH) TO PROPERTY OR PERSONS CAUSED BY OR ARISING AS A RESULT
OF OR IN CONNECTION WITH ANY PRODUCT OR COMPONENT. IN NO EVENT WILL THE LIABILITY
OF PULSE BIOTECH, LLC OR ANY THIRD PARTY SUPPLIER EXCEED THE PRICE PAID FOR ANY
PRODUCT OR COMPONENT. THE FOREGOING LIMITATIONS OF WARRANTIES AND DAMAGES
SHALL APPLY REGARDLESS OF THE FORM OF ACTION OR THEORY ON WHICH ANY CLAIM IS MADE,
INCLUDING CONTRACT, TORT OR OTHERWISE.
NOTE: Under the local law of the locality where the end user customer uses the system, certain limitations of
this limited warranty may not apply to the end user customer, and in such event and to the extent this limited
warranty is inconsistent with local law, this limited warranty shall be deemed modified to be consistent with
local law.
