EMISSION CONTROL SYSTEM WARRANTY
=mission Control System Warranty ("ECS Warranty") for 1995 and
ater model year California small off-road engines (for other states,
1 9 9 7 a n d l a t e r m o d e l y e a r e n g i n e s ) :
APPLICABILITY: This warranty shall apply to 1995 and later
model year California small off-road engines (for other states,
1997 and later model year engines). The ECS Warranty Period
shall begin on the date the new engine or equipment is delivered
t o i t s o r i g i n a l , e n d - u s e p u r c h a s e r , a n d s h a l l c o n t i n u e f o r 2 4
consecutive months thereafter.
B . G E N E R A L E M I S S I O N S W A R R A N T Y
C O V E R A G E : T e c u m s e h
Products Co. warrants to the original, end-use purchaser of the
n e w e n q i n e o r e q u i p m e n t a n d t o e a c h s u b s e q u e n t p u r c h a s e r
that each of its small off-road engines is:
1 . D e s i g n e d , b u i l t a n d e q u i p p e d s o a s t o c o n f o r m w i t h a l l
applicable regulations adopted by the Air Flesources Board
pursuant to its authority in Chapters 1 and2, Paft 5, Division
26 of the Health and Safety Code, and
2. Free from deiects in materials and workmanshio which. at
a n y t i m e d u r i n g t h e E C S W a r r a n t y P e r i o d , w i l l c a u s e a
warranted emissions-related part to fail to be identical in all
material respects to the paft as described in the engine
manufacturer's application for certification
C. The ECS Warranty only pertains to emissions-related parts on
y o u r e n g i n e , a s f o l l o w s :
A n y w a r r a n t e d , e m i s s i o n s - r e l a t e d p a r t s w h i c h a r e n o l
scheduled for replacement as required maintenance in the
Owner's Manual shall be warranted for the ECS Warranty
P e r i o d . l f a n y s u c h p a r t f a i l s d u r i n g t h e E C S W a r r a n t y
Period, it shall be repaired or replaced by Tecumseh Products
Co. according to Subsection 4 below. Any such part repaired
or replaced under the ECS Warranty shall be warranted for
any remainder of the ECS Warranty Period.
Any warranted, emissions-related paft which is scheduled
o n l y f o r r e g u l a r i n s p e c t i o n a s s p e c i f i e d i n t h e O w n e r ' s
Manual shall be warranted for the ECS Warranty Period. A
statement in such written instructions to the effect of "reoair
or replace as necessary". shall not reduce the ECS Warranty
Period. Any such part repaired or replaced under the ECS
Warranty shall be warranted for the remainder of the ECS
Warranty Period.
Any warranted, emrssions-related paft which is scheduled
for replacement as reouired maintenance in the Owner's
Manual, shall be warranted for the period of time prior to
the first scheduled replacement point for that part. lf the
part fails prior to the first scheduled replacement, the part
shall be repaired or replaced by Tecumseh Products Co.
a c c o r d i n g t o S u b s e c t i o n 4 b e l o w . A n y s u c h e m i s s i o n s -
related part repaired or replaced under the ECS Warranty,
shall be warranted for the remainder of the ECS Warranty
Period prior to the f irst scheduled replacement point for such
em issions-related part.
Repair or replacement of any warranted, emissions-related
part under this ECS Warranty shall be performed at no
charge to the owner at a Tecumseh Authorized Service
Outlet.
5 . T h e o w n e r s h a l l n o t b e c h a r g e d f o r d i a g n o s t i c l a b o r w h i c h
leads to the determination that a pafl covered by the ECS
Warranty is in fact defective. provided that such diagnostic
work is performed at a Tecumseh Authorrzed Service Outlet.
6 . T e c u m s e h P r o d u c t s C o . s h a l l b e l i a b l e f o r d a m a g e s t o o t h e r
o r i g i n a l e n g i n e c o m p o n e n t s o r a p p r o v e d m o d i t i c a t i o n s
p r o x i m a t e l y c a u s e d b y a f a i l u r e u n d e r w a r r a n t y o f a n
e m i s s i o n - r e l a t e d
p a r t c o v e r e d b y t h e E C S W a r r a n t y .
7 . T h r o u g h o u t t h e E C S W a r r a n t y P e r i o d . T e c u m s e h P r o d u c t s
C o . s h a l l m a i n t a i n a s u p p l y o f w a r r a n t e d e m i s s i o n - r e l a t e d
p a r t s s u f f i c i e n t t o m e e t t h e e x p e c t e d d e m a n d f o r s u c h
emissron-related parts.
8 . A n y T e c u m s e h P r o d u c t s C o . a u t h o r i z e d a n d a p p r o v e d
e m i s s i o n - r e l a t e d
r e p l a c e m e n t p a r t m a y b e u s e d i n t h e
p e r f o r m a n c e o f a n y E C S W a r r a n t y m a i n t e n a n c e o r r e p a i r
a n d w i l l b e p r o v i d e d w i t h o u t c h a r g e t o t h e o l v n e r . S u c h u s e
s h a l l n o t r e d u c e T e c u m s e h P r o d u c t s C o . E C S W a r r a n t v
o b l i g a t i o n s .
9 . U n a p p r o v e d a d d - o n o r m o d i f i e d p a r t s m a y n o t b e u s e d t o
m o d i f y o r r e p a i r a T e c u m s e h P r o d u c t s C o e n g i n e . S u c h
u s e v o i d s t h i s E C S W a r r a n t y a n d s n a I b e s u f l r c r e n t g r o u n d s
for disallowing an ECS Wai'ranty cla m. Tecumseh Products
Co. shall not be liable hereunder for failures of any warranted
p a r t s o f a T e c u m s e h P r o d u c t s C o e n g i n e c a u s e d b y t h e
u s e o f s u c h a n u n a p p r o v e d a d d - o n o r m o d i f i e d p a f t .
