AOL SOFTWARE END USER AGREEMENT FOR AIM
Software. You can register for a User ID by visiting www.aol.com or www.aim.com. Your
registration and use of your User ID are subject to separate terms and conditions, which
you agree you will abide by when you access our services through the Software.
6. YOUR REPRESENTATIONS. By using the Software, you signify that you have
adequate legal capacity to enter into this Agreement, that you will use the Software only
for lawful purposes and that you will not violate the terms of this Agreement.
7. AUTOMATED UPDATES. We or one of our distributors may deliver to your device
automated updates or patches to address issues such as security, interoperability, and
performance (collectively "Updates"). You authorize us to deliver automatically any
Update if we believe it is necessary to provide for the continued functionality of the
Software. Your use of the Updates will be governed by this Agreement unless you are asked
to agree to new or additional terms and conditions at the time of download or installation.
8. PERFORMANCE AND USAGE INFORMATION. The Software may report back
information automatically relating to device errors and settings in connection with use of
the Software, without notice to you, in order to help diagnose performance issues with,
and improve, the Software. The Software may also provide us with information about use
of Software features, which we would use in the aggregate to determine which Software
features are most popular and useful to its users.
9. THIRD PARTY OFFERINGS. We make no representations or warranties, express
or implied, regarding any third party applications or plug-ins that may be offered with
the Software by our distributors. We have no obligation to fix errors, bugs or to provide
enhancements to make the Software accessible through or compatible with these third
party applications.
10. TERMINATION. We may terminate this Agreement immediately if you violate any
term of this Agreement. In such event, you must uninstall the Software.
11. INJUNCTIVE RELIEF. You agree that your breach or threatened breach of this
Agreement will cause us irreparable damage for which recovery of money damages would
be inadequate and that we, therefore, may obtain timely injunctive relief to protect our
rights under this Agreement in addition to any and all other remedies available to us at law
or in equity.
12. DISCLAIMER OF WARRANTY.
WE LICENSE THE SOFTWARE "AS IS" AND WITH ALL FAULTS. YOU USE IT
AT YOUR OWN RISK. WE AND OUR DISTRIBUTORS DISCLAIM ALL EXPRESS
AND IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-
INFRINGEMENT OR ACCURACY, UNLESS SUCH IMPLIED WARRANTIES ARE
LEGALLY INCAPABLE OF EXCLUSION. WE DO NOT WARRANT THAT THIS
SOFTWARE WILL MEET YOUR REQUIREMENTS OR OPERATE WITHOUT
INTERRUPTION. IF ANY IMPLIED WARRANTY MAY NOT BE DISCLAIMED
UNDER APPLICABLE LAW, THEN SUCH IMPLIED WARRANTY IS LIMITED TO
30 DAYS FROM THE DATE YOU ACQUIRED THE SOFTWARE FROM US OR OUR
AUTHORIZED DISTRIBUTOR.
