4 Defect or damage resulting from poor environmental
conditions, such as extreme temperature or humidity,
variations in electric voltage, forces of nature, etc. or resulting
from any other acts beyond FUJITSU's reasonable control.
5 Damage or malfunction due to a defective function of the
cellular network, or due to any communication service or
signal you may subscribe to or use with the Product. Defect or
need of software upgrade due to change of parameters of the
cellular network after the Product has been purchased, are also
not covered by the warranty.
6 Failure or damage resulting from the use of or connection to
any equipment, accessory, software or other peripheral device
which is not FUJITSU-branded original Product, officially
specified and approved for use with F-022 mobile phone
terminal.
7 Failure or damage resulting from installation, adjustment,
repair, modification or opening of the Product performed by a
non-authorized person.
8 Product with any inscription sticker that has been removed,
altered, obliterated or made illegible, or that shows evidence of
tampering.
9 Defect caused by the fact that the battery was short-circuited or
was used in equipment other than the one for which it has been
specified.
10 Malfunction or damage caused by any downloaded contents,
data or application, and loss or deterioration of the said
downloaded contents, data or application.

11 Software embodied in physical media, such as CD-ROM, is
provided "as is", and no warranty is made that the software will
meet your requirements or will work in combination with any
equipment or application provided by third parties and that the
operation of the software will be uninterrupted or error free.
12 The display may have some dots always lit or unlit, and minor
variations in display brightness and color may occur between
mobile phones: this shows characteristics of liquid crystal
displays and not defects in the mobile phone terminal. Repair
of the display or external connector if broken after purchase is
also not covered by the warranty.
13 IN NO EVENT SHALL WE BE LIABLE, WHETHER IN CONTRACT
OR TORT(INCLUDING NEGLIGENCE) FORDAMAGES IN
EXCESS OF THE PURCHASE PRICE OF THE PRODUCT, OR FOR
ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL
DAMAGES OF ANY KIND, OR LOSS OF REVENUE OR PROFITS,
LOSS OF BUSINESS, LOSS OF INFORMATION OR DATA,
SOFTWARE OR APPLICATIONS OR OTHER FINANCIAL LOSS
ARISING OUT OF OR IN CONNECTION WITH THE ABILITY OR
INABILITY TO USE THE PRODUCT TO THE FULL EXTENT
THESE DAMAGES MAY BE DISCLAIMED BY LAW.
Some states and jurisdictions do not allow the exclusion or
limitation of incidental or consequential damages to its fullest
extent under certain circumstances, so the preceding
limitations or exclusions may not apply to you.
